METLAND TRAVELMATE PROGRAM
The Metland Travelmate Loyalty Program (“Program”) is provided by PT. Metropolitan Land Tbk and its subsidiaries and affiliates (“We”), in collaboration with relevant parties to implement this Program. In implementing this Program, we will always uphold the value of integrity in respecting and protecting any personal data or information submitted by Members in the Program.
In this Privacy Policy, We determine the basis for the acquisition, collection, processing, analysis, display, announcement, correction, update, change, transfer, dissemination, disclosure, publication, deletion and/or any form of management related to personal data or information that Members provide to Us, in this case also including Members' personal data when registering, accessing, or using services in the Program ("Personal Data").
By accessing and using the services of this Program, Members hereby declare that all information provided by Members is true, accurate, valid and up-to-date data, Members also give us their consent to obtain, collect, store, change, analyze, manage and/or use such data as stated in the Privacy Policy and Program Terms and Conditions.
2. Acquisition and Collection of Member Personal Data
When a Member joins the Program, We collect Member Personal Data which includes electronic information in the form of text, sound, images, and other similar forms for the purpose of processing Member transactions, managing and streamlining the Program service process, and other purposes stipulated in the Metland Travemate Program Terms and Conditions in connection with the Program as permitted by applicable laws and/or regulations. The Member Personal Data collected include
2.1. Member Personal Data that Members provide independently, including but not limited to data provided by Members when:
2.1.1 Create or update an account on the Program which includes the Member's name (both real name and username), password,address, telephone number, email address, photo, etc
2.1.2. Contact Us regarding the use of the Program and consumer services
2.1.3. Submission of Personal Data required in connection with the Metland Travelmate Loyalty Program.
2.1.4. Fill out the survey sent by us.
2.1.5. Use any services or features in the Program as stipulated in the Terms and Conditions in the Program.
2.1.6. Using features that require access permission to Member devices in the Program.
2.2. Member Personal Data contained in the Program when the Member uses the Program or when registering to use the Program, including but not limited to:ogram, including but not limited to:
2.2.1. Member identity data such as
KTP/PASSPORT/KITAS.
2.2.2. Data in the form of the time of each Member activity, including registration activities, login, transactions, and so on
2.2.3. Mobile terminal identifiers, access information to the Program, and other information based on Member use of the Program; and/or
2.2.4. log data, including records on the
server that receives data such as the device's IP address, date and time of
access, Program services or pages viewed, Program work processes and other system activities, browser type, and/or third-party applications or services
that Members use before using the Program.
2.2.5. Member usage or preference data,
including Member interactions in using the Program, saved choices, and Member
selected settings. This data is collected using cookies, pixel tags, and similar technologies that create and maintain unique identifiers.
2.2.6. Device data, including the type of device used to access the Program, including hardware model, operating system and version, software, file name and version, language selection, unique device identifier, advertising identifier, device serial number.
2.3. Member Personal Data obtained from other sources, including
2.3.1. Management, including data and information related to Member Residential ownership and other information that may be requested and submitted by the Member in connection with a transaction with Management and/or the Management Group
2.3.2. Marketing and advertising service providers, large-scale data analysts, artificial intelligence, and other third-party service providers; an
2.3.3. Publicly available sources.
2.3.4. Business partners who provide services that support and/or facilitate Members in creating or accessing our accounts on the Program, such as social media services, advertising, or sites/applications that use this Program.
2.3.5. Business partners who participate in developing and providing services in the Program to Members, including partners providing Program infrastructure and other partners.
2.3.6. Business partners who provide services that support and/or facilitate Members in creating or accessing our accounts on the Program, such as social media services, advertising, or sites/applications that use this Program
By agreeing to this Privacy Policy, Members hereby represent and warrant that they have authorized the collection, storage, transmission, management, and delivery of all Personal Data submitted to us prior to joining the Program. Members hereby release us from all legal liability and will not file any lawsuits or claims regarding any matters related to their Personal Data in this Program.
3.1 Using data obtained from Members for product marketing purposes and measuring the effectiveness of advertising for a product promotion, including to improve the security of services in the Program
3.2. Informing Members about products, services, promotions, the latest developments, events, and other information, both through the Program and other media. We may use Members' personal data to promote and process sweepstakes and award prizes, as well as to provide relevant content about our services and those of our business partners who are part of the Metland Travelmate Program
3.3. Process all forms of requests, activities and transaction uploads made by Members through the Program, which are related to the Metland Travelmate Program
3.4. Providing features to deliver, implement, maintain and improve our products and services, including
3.4.1. Offering to obtain, provide, or facilitate reward services, parking, directories, or other products through the Program, including providing information about events and advertising products or services provided by Us and/or other companies appointed by Manage
3.4.2. Enables features to personalize or personalize Member accounts on the Program.
3.4.3. Implementation of internal activities required to provide and maximize services in the Program, such as troubleshooting software problems, bugs, operational issues, as well as conducting data analysis, testing, research, to monitor and analyze usage and activity trends and other things that support Program service
3.5. Assisting Members when communicating with customer service or Program consumer services, including:
3.5.1. Check and resolve Member problems in using Program services
3.5.2. Direct Member questions to the appropriate customer service officer to resolve the problem
3.5.3. Monitor and improve Program customer service response
3.6. Product improvement and development and quality of customer service and other
3.7. Conduct monitoring or investigations into suspicious transactions or those that are indicated to contain elements of fraud or violations of the Terms and Conditions of the Program related to the Metland Travelmate Program by taking the necessary actions as a follow-up to the results of monitoring or investigating these transaction
3.8. Contacting Members via email, telephone and others, including for notifications, authentication, providing information about products and services managed by us and tenants, as well as assisting and/or completing transaction processes and problem-solving processes.
4. Disclosure of Member Personal Day
4.1. We guarantee that there will be no sale, transfer, sharing or lending of Member Personal Data to other third parties, without the permission or approval of the Member, except in the following case.
4.1.1. For the benefit of Management and/or Management Group as controller of Personal Data or partners or other third parties of Management and/or Management Group as those who assist in onnection with the provision of Program services, data processing, and processing all forms of Member activities in the Program, including processing transactions, transaction verification and membership and the Metland Travelmate Program.
4.1.2. In carrying out coordination with our business partners regarding risk mitigation, resolving obstacles or other matters that we deem necessary to protect the interests of members
4.1.3. As a provider of information required by vendors, consultants, marketing partners, and research institutions, or providing similar services for other purposes as regulated in Article 3 (Use of Member Personal Data).
4.1.4. We may provide necessary Personal Data to Our business partners in order to facilitate Members' use of their services, including other applications or websites that have been integrated or connected to the Program or its services, or business partners who have collaborated with Us in conducting promotions, lotteries, or services related to the Application.
4.2. Members agree and give us permission to transfer, disclose, process and process Member Personal Data outside the territory of the Unitary State of the Republic of Indonesia as long as it is permitted by applicable laws and regulations.
4.3. We may also disclose Member Personal Data in order to comply with legal provisions and/or statutory regulations, in response to legitimate requests from law enforcement officials and in connection with legal proceedings in court or due to a court decision that has permanent legal force.
4.4. We will take all reasonable and necessary steps to protect Member Personal Data that is disclosed or transferred to any third party with a standard of protection equivalent to the provisions of this Privacy Policy.
5. Member Personal Data Storage
We will not retain Member Personal Data for longer than is necessary as outlined in fulfilling the purposes of use set out in Article 3 (Use of Member Personal Data) of this Privacy Policy and as required by applicable laws and/or regulations regarding the retention of Personal Data.

We will always ensure that Member's Personal Data is fully protected to the best of our ability. However, if Member's Personal Data is leaked due to actions beyond our control, Member authorizes us to notify Member via electronic means of such Personal Data leak. As long as it can be proven that the leak of Member's Personal Data was beyond our control, Member hereby releases us from all future civil and criminal claims related to the leak of Personal Data caused by actions beyond our control.
8. Privacy Policy Changes
We, at our sole discretion, may make changes or updates to this Privacy Policy at any time. These changes will be effective in any manner, including, but not limited to, posting a revised version of the Privacy Policy on the Application. In such cases, Members should review the Program Terms and Conditions to stay informed of any changes that may affect their Personal Data. Members' use of the Application constitutes their continued agreement to be bound by this Privacy Policy and any amendments thereto, as amended from time to time. We reserve the right to make any changes to the Privacy Policy that we deem appropriate.
9. Transparency and Member Choice
9.1. Mobile devices in general (iOS, Android, etc.) have settings that prevent the Program from accessing certain data without the Member's consent. iOS devices will notify the Member when the Program first requests access to that data, while Android devices will notify the Member when the Application is first loaded and the Member will be asked to provide consent to the notification when the Application first requests access to that data (for iOS Devices) or when the Application is first loaded (for Android devices).
9.2. Members can access and change information in the form of email address, telephone number, date of birth, gender, address list, payment method, and bank account if the Program provides these services as well as other Personal Data through the Settings feature in the Program if the Application has a payment feature
9.3. To the extent permitted by applicable laws and regulations, Members may contact us to withdraw their consent to the acquisition, collection, storage, management, and use of their Personal Data. In such cases, Members understand that this will result in their inability to use the Program or other related company services.
10. Cookie
10.1 Cookies are a collection of information containing a track record and activity when browsing a website which will automatically take place on the Member's device which carries out the function of storing Member preferences and configurations while visiting a website.
10.2 Cookies are not intended to be used when accessing other data that Members have on Members' mobile devices, other than what Members have agreed to convey.
10.3 Although Member's Mobile device will automatically accept cookies, Member can choose to make modifications through Member's browser settings, namely by choosing to reject cookies (this choice may limit optimal service when accessing the Program).
10.4 We may use features provided by third parties in order to improve the Program services, including customizing and presenting advertisements to each Member based on their interests or visit history.
11. Member Consent to Privacy Policy
By using and/or clicking agree on the form or column agreeing to this Privacy Policy, Members hereby declare that they give their consent to Us to use Member's Personal Data in accordance with the provisions of this Privacy Policy.
By
using Our Platform, you are deemed to agree to this Privacy Policy, including
but not limited to all changes to it.
PROGRAM METLAND TRAVELMATE
1. Pendahuluan
Program Loyalitas Metland Travelmate (“Program”) disediakan oleh kami, PT. Metropolitan Land Tbk beserta anak perusahaan dan afiliasinya (“Kami”), yang dalam rangka penyelenggaraan Program ini bekerja sama dengan pihak-pihak terkait. Kami dalam penyelenggaraan Program ini akan akan selalu menjunjung tinggi nilai integritas dalam menghargai dan melindungi setiap data atau informasi pribadi yang diserahkan oleh Member dalam Program.
Dalam Kebijakan Privasi ini, Kami menentukan dasar atas perolehan, pengumpulan, pengolahan, penganalisaan, penampilan, pengumuman, perbaikan, pembaruan, pengubahan pengalihan, penyebarluasan, pengungkapan, mempublikasikan, penghapusan dan/atau segala bentuk pengelolaan yang terkait dengan data atau informasi pribadi yang Member berikan kepada Kami, dalam hal ini juga termasuk data pribadi Member pada saat melakukan registrasi, mengakses, maupun mempergunakan layanan-layanan pada Program (“Data Pribadi”).
Dengan mengakses dan menggunakan layanan Program ini, Member dengan ini menyatakan bahwa setiap informasi yang diberikan oleh Member merupakan data yang benar, akurat, sah dan terbaru, Member juga memberikan persetujuan kepada Kami untuk memperoleh, mengumpulkan, menyimpan, mengubah, menganalisa, mengelola dan/atau menggunakan data tersebut sebagaimana tercantum dalam Kebijakan Privasi maupun Syarat dan Ketentuan Program.
2. Perolehan dan Pengumpulan Data Pribadi
Member
Pada saat Member bergabung di Program, Kami mengumpulkan Data Pribadi Member yang mencakup informasi elektronik berupa teks, suara, gambar, dan bentuk lainnya yang sejenis yang bertujuan untuk memproses transaksi Member, mengelola dan memperlancar proses layanan Program, serta tujuan-tujuan lainnya yang diatur dalam Syarat dan Ketentuan Program Metland Travemate sehubungan dengan Program yang diperbolehkan oleh hukum dan/atau peraturan perundang-undangan yang berlaku. Data Pribadi Member yang dikumpulkan meliputi:
2.1. Data Pribadi Member yang diberikan Member secara mandiri, termasuk tetapi tidak terbatas pada data yang diberikan Member pada saat:
2.1.1. Membuat atau memperbarui akun pada
Program yang meliputi nama Member (baik nama asli maupun username), password,
alamat, nomor telepon, alamat email, foto dan lain-lain.
2.1.2. Menghubungi Kami terkait dengan
penggunaan Program dan layanan konsumen.
2.1.3. Penyerahan Data Pribadi yang
diperlukan terkait Program Loyalitas Metland Travelmate.
2.1.4. Mengisi survey yang dikirimkan
oleh Kami.
2.1.5. Menggunakan layanan-layanan atau
fitur apapun pada Program sesuai yang diatur dalam Syarat dan Ketentuan di
Program.
2.1.6. Menggunakan fitur yang membutuhkan izin akses terhadap perangkat Member pada Program.
2.2. Data Pribadi Member yang termuat
dalam Program pada saat Member mempergunakan Program maupun pada saat
registrasi untuk menggunakan Program, termasuk dan tidak terbatas pada:
2.2.1. Data identitas Member seperti
KTP/PASSPORT/KITAS.
2.2.2. Data berupa waktu dari setiap
aktivitas Member, termasuk aktivitas pendaftaran, login, transaksi, dan lain
sebagainya
2.2.3. Pengidentifikasi terminal seluler,
akses informasi ke Program, dan informasi lainnya berdasarkan penggunaan
Program oleh Member; dan/atau
2.2.4. Data catatan (log), diantaranya catatan pada server yang menerima data seperti alamat IP perangkat, tanggal dan waktu akses, layanan Program atau laman yang dilihat, proses kerja Program dan aktivitas sistem lainnya, jenis peramban, dan/atau aplikasi aplikasi atau layanan pihak ketiga yang Member gunakan sebelum menggunakan Program.
2.2.5. Data penggunaan atau preferensi Member, diantaranya interaksi Member dalam penggunaan Program, pilihan yang disimpan, dan pengaturan yang dipilih Member. Data-data tersebut diperoleh menggunakan cookies, pixel tags dan teknologi serupa yang menciptakan dan mempertahankan pengenal unik.
2.2.6. Data perangkat, diantaranya jenis perangkat yang digunakan untuk mengakses Program, termasuk model perangkat keras, sistem operasi dan versinya, perangkat lunak, nama file dan versinya, pilihan bahasa, pengenal perangkat unik, pengenal iklan, nomor seri perangkat.
2.3. Data Pribadi Member yang diperoleh
dari sumber lain, termasuk:
2.3.1. Manajemen, termasuk data dan informasi terkait kepemilikan Residensial Member serta informasi lain yang mungkin dan diminta dan diserahkan oleh Member sehubungan dengan suatu transaksi dengan Manajemen dan/atau Group Manajemen
2.3.2. Penyedia layanan pemasaran dan periklanan, analis data skala besar, artificial intelligence, dan penyedia layanan pihak ketiga lain; dan
2.3.3. Sumber yang tersedia secara umum
2.3.4. Mitra usaha yang menyediakan layanan yang mendukung dan/atau memfasilitasi Member membuat atau mengakses akun Kami pada Program, seperti layanan media sosial, periklanan, atau situs/aplikasi yang menggunakan Program ini.
2.3.5. Mitra usaha yang turut serta mengembangkan dan menyajikan layanan-layanan dalam Program kepada Member, antara lain mitra penyedia infrastruktur Program, dan mitra mitra lainnya.
2.3.6. Mitra usaha yang menyediakan layanan yang mendukung dan/atau memfasilitasi Member dalam membuat atau mengakses akun Kami pada Program, seperti layanan media sosial, periklanan, atau situs/aplikasi yang menggunakan Program ini.
Dengan menyetujui Kebijakan Privasi ini, Member dengan ini menyatakan dan menjamin bahwa Member telah mengizinkan pengumpulan, penyimpanan, pengiriman, pengelolaan, dan penyampaian seluruh Data Pribadi yang telah diserahkan kepada Kami sebelum Member bergabung pada Program. Dengan ini Member membebaskan Kami atas segala tanggung jawab hukum dan tidak akan melakukan tuntutan atau gugatan hukum sehubungan dengan segala hal yang terkait Data Pribadi member pada Program ini.
2.4. Jika dengan alasan apapun Member menyampaikan, mengirimkan, mendistribusikan atau dengan cara lain apapun memberikan akses kepada Kami suatu informasi pribadi milik pihak ketiga, Member dengan ini menyatakan dan menjamin bahwa informasi pribadi milik pihak ketiga tersebut telah diperoleh, dikirimkan, disampaikan, atau dengan cara apapun dibuka aksesnya dengan persetujuan dari pihak ketiga tersebut dan dengan cara yang sesuai dengan peraturan perundang-undangan yang berlaku di Republik Indonesia. Member dengan ini menyatakan bertanggungjawab secara penuh dan membebaskan Kami dari segala tanggungjawab atas penyampaian, pengiriman, pendistribusian atau pengungkapan informasi pribadi terkait pihak ketiga yang disampaikan kepada Kami.
2.5. Program tidak ditujukan untuk anak-anak di bawah usia 17 tahun. Sebagai orang tua atau wali hukum yang sah (kecuali bagi orang tua/wali yang mendaftarkan anaknya sebagai kartutambahan), mohon untuk tidak memberikan ijin bagi anak-anak yang berada di asuhan Anda untuk menyerahkan data pribadi kepada Kami. Dalam hal data pribadi dari anak-anak di bawah usia 17 tahun yang berada di bawah asuhan Anda dibuka kepada Kami, Anda dengan ini menyetujui pemrosesan data pribadi anak tersebut dan menerima serta menyetujui untuk terikat pada Kebijakan Privasi ini atas nama anak tersebut.
3. Data Pribadi Member yang diperoleh dan
dikumpulkan dalam Program ini dapat Kami gunakan keseluruhan atau
sebagiannya untuk hal-hal sebagai berikut:
3.1. Menggunakan data yang diperoleh dari Member untuk tujuan pemasaran produk dan mengukur efektifitas periklanan untuk suatu promosi produk termasuk untuk meningkatkan keamanan layanan-layanan pada Program.
3.2 Menginformsaikan kepada Member terkait produk, layanan, promosi, informasi perkembangan terbaru, acara dan lain-lain, baik melalui Program maupun media lainnya. Kami dapat menggunakan data pribadi Member guna mempromosikan dan memproses undian dan memberikan hadiah undian serta menyajikan konten yang relevan tentang layanan Kami dan mitra usaha Kami yang merupakan bagian dari Program Metland Travelmate.
3.3. Memproses segala bentuk
permintaan, aktivitas maupun unggahan transaksi yang dilakukan oleh Member
melalui Program, yang terkait dengan Program Metland Travelmate.
3.4. Menyediakan fitur-fitur untuk
memberikan, mewujudkan, memelihara dan memperbaiki produk dan layanan Kami,
termasuk:
3.4.1. Menawarkan memperoleh, menyediakan, atau memfasilitasi layanan reward, parkir, directory, maupun produk-produk lainnya melalui Program termasuk memberikan informasi mengenai adanya acara (event) serta iklan produk atau jasa yang disediakan oleh Kami dan/atau perusahaan lain yang ditunjuk oleh Manajemen.
3.4.2. Memungkinkan fitur untuk mempribadikan atau mempersonalisasi akun Member pada Program.
3.4.3. Pelaksanaan kegiatan internal yang diperlukan untuk penyediaan serta memaksimalkan layanan pada Program, seperti pemecahan masalah software, bug, permasalahan operasional, serta melakukan analisis data, pengujian, penelitian, untuk memantau dan menganalisa kecenderungan penggunaan dan aktivitas serta hal-hal lainnya yang mendukung layanan Program.
3.5. Membantu Member saat melakukan komunikasi dengan customer service atau layanan konsumen Program, antara lain:
3.5.1. Memeriksa dan mengatasi permasalahan Member dalam menggunakan layanan Program.
3.5.2. Mengarahkan pertanyaan Member kepada petugas customer service atau layanan konsumen yang tepat untuk mengatasi permasalahan.
3.5.3. Mengawasi dan memperbaiki tanggapan layanan pelanggan Program.
3.6. Peningkatan dan pengembangan
produk dan kualitas layanan pelanggan dan lainnya.
3.7. Melakukan monitoring ataupun
investigasi terhadap transaksi-transaksi mencurigakan atau yang terindikasi
mengandung unsur kecurangan atau pelanggaran terhadap Syarat dan Ketentuan dari
Program yang terkait dengan Program Metland Travelmate dengan melakukan
tindakan-tindakan yang diperlukan sebagai tindak lanjut dari hasil monitoring
atau investigasi transaksi tersebut.
3.8. Menghubungi Member melalui email, telepon dan lain-lain, termasuk untuk notifikasi, otentikasi menyediakan Informasi tentang produk dan layanan yang dikelola oleh Kami dan tenant serta membantu dan/atau menyelesaikan proses transaksi maupun proses penyelesaian kendala.
4. Pengungkapan Data Pribadi Member
4.1. Kami menjamin tidak akan terjadi
penjualan, transfer, pembagian atau peminjaman atas Data Pribadi Member kepada
pihak ketiga lainnya, tanpa adanya izin atau persetujuan dari Member, kecuali
dalam hal-hal sebagai berikut:
4.1.1. Untuk kepentingan Manajemen dan/atau Group Manajemen sebagai pengendali Data Pribadi maupun mitra atau pihak ketiga lainnya dari Manajemen dan/atau Group Manajemen sebagai yang membantu sehubungan dengan penyediaan layanan Program, pengolahan data, dan memproses segala bentuk aktivitas Member dalam Program, termasuk memproses transaksi, verifikasi transaksi maupun keangggotaan dan Program Metland Travelmate.
4.1.2. Dalam melaksanakan koordinasi dengan mitra usaha Kami sehubungan dengan mitigasi resiko, penyelesaian kendala atau hal-hal lain yang Kami anggap perlu dalam melindungi kepentingan Member
4.1.3. Sebagai penyediaan informasi yang diperlukan oleh vendor, konsultan, mitra pemasaran, serta lembaga riset, atau penyediaan layanan serupa untuk tujuan-tujuan lainnya yang diatur dalam Pasal 3 (Penggunaan Data Pribadi Member).
4.1.4. Kami dapat menyediakan Data Pribadi yang diperlukan kepada mitra usaha Kami dalam rangka memfasilitasi penggunaan layanan mitra usaha oleh Member, termasuk diantaranya aplikasi atau situs web lain yang telah terintegrasi atau terhubung dengan Program atau layanannya, atau mitra usaha yang telah bekerjasama dengan Kami dalam melakukan promosi, undian, atau layanan yang berkaitan dengan Aplikasi.
4.2. Member menyetujui dan memberi persetujuan kepada Kami untuk mengalihkan, mengungkapkan, mengolah dan memproses Data Pribadi Member di luar wilayah Negara Kesatuan Republik Indonesia sepanjang diperkenankan oleh peraturan perundang-undangan yang berlaku.
4.3. Kami juga dapat mengungkapkan Data Pribadi Member dalam rangka mematuhi ketentuan-ketentuan hukum dan/atau peraturan perundang-undangan, adanya permintaan yang sah dari aparat penegak hukum serta sehubungan dengan adanya proses hukum di peradilan ataupun karena adanya putusan pengadilan yang berkekuatan hukum tetap.
4.4. Kami akan mengambil segala langkah yang wajar dan diperlukan dalam melindungi Data Pribadi Member yang diungkapkan atau dialihkan kepada pihak ketiga manapun dengan standar perlindungan yang setara dengan ketentuan Kebijakan Privasi ini.
5. Penyimpanan Data Pribadi Member
Kami tidak akan menyimpan Data Pribadi Member lebih lama dari yang dibutuhkan sebagaimana diuraikan dalam memenuhi tujuan penggunaan yang diatur dalam Pasal 3 (Penggunaan Data Pribadi Member) dari Kebijakan Privasi ini dan sebagaimana dipersyaratkan oleh ketentuan hukum dan/atau peraturan perundangan-undangan yang berlaku yang berkenaan dengan retensi Data Pribadi.
6. Penghapusan Data Pribadi Member
Member dapat meminta Kami untuk melakukan penghapusan Data Pribadi
Member sesuai kebutuhan yang disertai dengan alasan dan data pendukung yang sah
termasuk untuk menghubungi Kami sehubungan dengan penggunaan Data Pribadi pada

7. Pemberitahuan Kebocoran Data Pribadi Member
Kami akan senantiasa memastikan bahwa Data Pribadi Member dilindungi sepenuhnya dengan seluruh kemampuan Kami, namun jika Data Pribadi Member bocor yang disebabkan oleh tindakan di luar kendali Kami, Member mengizinkan Kami untuk memberitahu Member melalui sarana elektronik mengenai kebocoran Data Pribadi tersebut. Sepanjang dapat dibuktikan bahwa kebocoran Data Pribadi Member tersebut diluar kekuasaan Kami, maka Member dengan ini membebaskan Kami dari segala tuntutan baik perdata maupun pidana dikemudian hari terhadap kebocoran Data Pribadi yang disebabkan tindakan diluar kekuasaan Kami.
8. Perubahan Kebijakan Privasi
Kami dengan kebijakan Kami sendiri dapat sewaktu-waktu melakukan perubahan atau pembaruan terhadap Kebijakan Privasi ini. Dan perubahan tersebut berlaku dengan cara apapun, termasuk namun tidak terbatas pada, dengan memasang versi revisi dari Kebijakan Privasi pada Aplikasi. Dalam hal tersebut, Member dapat melihat ketentuan pada Program untuk tetap mengetahui perubahan yang mungkin mempengaruhi Data Pribadi Member. Penggunaan Aplikasi oleh Member merupakan persetujuan berkelanjutan Member untuk terikat oleh Kebijakan Privasi ini dan perubahannya sebagaimana diubah dari waktu ke waktu. Kami berhak untuk melakukan perubahan apapun yang Kami anggap tepat pada Kebijakan Privasi.
9. Transparansi dan Pilihan Member
9.1. Perangkat seluler pada umumnya (iOS, Android, dan sebagainya) memiliki pengaturan sehingga Program tidak dapat mengakses data tertentu tanpa persetujuan dari Member. Perangkat iOS akan memberikan pemberitahuan kepada Member saat Program pertama kali meminta akses terhadap data tersebut, sedangkan perangkat Android akan memberikan pemberitahuan kepada Member saat Aplikasi pertama kali dimuat dan Member diminta untuk memberikan persetujuan terhadap pemberitahuan tersebut pada saat Aplikasi pertama kali meminta akses terhadap data tersebut (untuk Perangkat iOS) atau pada saat Aplikasi pertama kali dimuat (untuk perangkat Android).
9.2. Member dapat mengakses dan mengubah informasi berupa alamat email, nomor telepon, tanggal lahir, jenis kelamin, daftar alamat, metode pembayaran, dan rekening bank bilamana Program menyediakan layanan-layanan tersebut serta Data Pribadi lainnya melalui fitur Pengaturan pada Program apabila Aplikasi memiliki fitur pembayaran.
9.3. Sejauh diizinkan oleh ketentuan peraturan perundangan-undangan yang berlaku, Member dapat menghubungi Kami untuk melakukan penarikan persetujuan terhadap perolehan, pengumpulan, penyimpanan, pengelolaan dan penggunaan Data Pribadi Member. Dalam hal tersebut, Member memahami konsekuensi bahwa Member tidak dapat menggunakan layanan Program maupun layanan perusahaan yang terkait lainnya.
10. Cookie
10.1 Cookie adalah kumpulan informasi yang berisi rekam jejak dan aktivitas ketika menelusuri sebuah website yang secara otomatis akan mengambil tempat didalam perangkat Member yang menjalankan fungsi dalam penyimpanan preferensi maupun konfigurasi Member selama mengunjungi suatu situs website.
10.2 Cookie tidak diperuntukkan untuk digunakan pada saat melakukan akses data lain yang Member miliki di perangkat Selular Member, selain dari yang telah Member setujui untuk disampaikan.
10.3 Meskipun perangkat Selular Member akan secara otomatis menerima cookie, Member dapat menentukan pilihan dalam melakukan modifikasi melalui pengaturan browser Member yaitu dengan memilih untuk menolak cookie (pilihan ini dapat membatasi layanan optimal pada saat melakukan akses ke Program).
10.4 Kami dapat menggunakan fitur-fitur yang disediakan oleh pihak ketiga dalam rangka meningkatkan layanan Program, termasuk diantaranya adalah penyesuaian dan penyajian iklan kepada setiap Member berdasarkan minat atau riwayat kunjungan.
11. Persetujuan Member atas Kebijakan Privasi
Dengan menggunakan dan/atau melakukan klik setuju pada form atau kolom persetujuan terhadap Kebijakan Privasi ini, Member dengan ini menyatakan memberikan persetujuan kepada Kami untuk menggunakan Data Pribadi Member sesuai dengan ketentuan-ketentuan dalam Kebijakan Privasi ini.
Dengan menggunakan Platform Kami, Anda dianggap menyetujui Kebijakan Privasi ini, termasuk namun tidak terbatas pada semua perubahannya.
TERMS & CONDITIONS OF USE
METLAND TRAVELMATE PROGRAM
Metland Travelmate Loyalty Program (hereinafter referred to as the “Program”) is presented by PT Metropolitan Land Tbk and its subsidiaries and affiliates. ("We").
By joining this Program, you are deemed to have read, understood, and consciously and without coercion agreed to the Metland Travelmate Loyalty Program Terms and Conditions ("Terms and Conditions"). We collect and use your personal information in accordance with our Privacy Policy.
2.1. “Member” or “You” is an individual who is eligible to register and is
registered in the Metland Travelmate membership program and has agreed to the
terms and conditions of Program membership.
2.2. “Platform” is the official website www.mhg.idand
the official application of Metland Hotels Group.
2.3. “Transactions” are activities carried out by Members to earn points and
achieve tiers.
2.4. “Points” are loyalty value units earned by Members from qualifying transactions, with different point conversions according to the following table:

2.7. “E-Voucher” means a coupon/voucher obtained from exchanging points
through the Platform which is valid as a means of payment at the Hotel, with a
validity period of 3 (three) months or 90 (ninety) days from the date of point
exchange.
2.8. “Hotel” means a hotel built and developed or managed by Metland Hotels
Group, including Hotel Horison Ultima Bekasi, Metland Smara Kertajati, Hotel
Horison Ultima Seminyak Bali, Metland Hotel Bekasi, Metland Hotel Cirebon, and
Metland Venya Ubud, including hotels that will be built and/or developed later.
2.9. “Check-in” is the date of arrival at the Hotel.
2.10. “Check-out” is the date of departure from the Hotel.
2.11. “Merchant” is a partner merchant of Metland Hotels Group as a party
that sells or buys services and/or products that can be exchanged for
E-Vouchers or other promotional content.
2.12. “Promotion” is a service from a sales promotion program that contains content offered to Members.
The hotels participating in this Program are hotels operating under the Metland Hotels Group network. When a hotel or brand joins the Metland Hotels Group network or registers in the Program as a participating hotel, Members will only be able to earn Points and enjoy other Program-related benefits on eligible stays completed at the hotel in question following this activity.
If
a hotel leaves the Metland Hotels Group network or ceases to be a participating
hotel after a Member has made a booking but before the Member's actual stay,
the following conditions apply to the Member:
a.
Will not earn
Points and will not have access to any services or benefits during your stay at
the hotel.
b. Will not have access to any special offers the hotel may be participating in.
Metland Hotels Group will make every effort to provide reasonable notice to affected Members prior to their stay.
This program is open to individuals who are legally considered adults or have the legal capacity to enter into contracts in the Member's home country.
Members receive an "E-Card" membership card, which is sent to them electronically, depending on their Tier. Membership cards are nominative and completely personal. They cannot be sold, loaned, or transferred. Membership cards are not a means of payment and cannot be used to guarantee reservations. The card displays the Member's name, identification number, and Tier expiration date. The rule is that one Metland Travelmate membership card per member can only be used by the member whose name is printed on the card (e-card).
A valid individual email address is required to join the Program. Two or more individuals may not use the same email address. By joining the Program, Members agree to receive electronic communications relating to the operation and services offered by the Program, including informational messages, Point statements, and information regarding the operation of the Member's account. If a Member no longer wishes to receive this information, which is deemed essential to the operation of the Program, the Member must comply with the Program termination provisions set out in Article 12.5.
Members agree that the Program may be changed, either in whole or in part, at any time. Members have the option to terminate their membership within a reasonable time prior to submission as outlined in Article 12.5. Participation in the Program after the effective date of the change implies acceptance by the Member.
To register for the Program, you must create a Member account by filling in the required information in the registration form, including a username (‘Username’). Members represent that the information provided in the registration form or submitted to Metland Hotels Group is true and complete. Metland Hotels Group is not responsible for any errors or incorrect/invalid information provided by Members, and as a result, Metland Hotels Group cannot provide Members with the full Program experience as described herein.
5.1.
Registration
Registration
is the process by which you enroll in the Program and become a Member. The
registration process is as follows:
5.1.1.
The minimum age limit to register
as a Member is 18 years at the time of registration.
5.1.2.
You'll be asked to register an
email address and a mobile phone number. One ID card is valid for only one
account.
5.1.3.
If the mobile phone number and
email address used are not registered in the Program, then you will be directed
to carry out the registration process first, by filling in the data name, email
address and mobile phone number, then you will receive an OTP code verification
which will be sent according to the email address that has been registered with
the mobile phone number.
5.1.4.
After the OTP code verification
process is successful, you will be directed to create a password and confirm
the password.
5.1.5.
Then you will get a Metland
Travelmate Member number which will be sent to the email address registered in
the Program.
5.1.6. You can now log in using the email or mobile phone number provided via email.
5.2.
Login
Login is the process of registering as a Member and wanting to use the Program. On the Login page, Members can use the same email address or mobile phone number they use on the Platform. This allows them to continue their existing data and progress on the Platform.
5.3.
By using an account, Members can:
5.3.1.
Know the total accumulated nights
(room nights) or total rooms (rooms), number of points, accumulated
transactions, transaction history, member tier level and benefits.
5.3.2.
Recognized on the mhg.id website
or mobile service.
5.3.3.
Know your reservation history and
current reservations.
5.3.4. Access personalized offers and services.
Member accounts are strictly private and confidential. Members are fully responsible for their storage and use. Metland Hotels Group is not responsible to members for any losses incurred due to unauthorized, fraudulent, or inappropriate account access errors or misuse.
You are solely responsible for maintaining the confidentiality of your password, membership number, and other account access information and for restricting access to your devices and account, including, without limitation, any email account associated with your account or Hotel stay, so that others cannot access your account, and We will not be liable for your failure to do so.
Any breach by the Member of these Terms and Conditions, non-payment of payment (hotel bills, invoices or other commitments) in connection with goods or services offered by the Hotel, Metland Hotels Group or their partners or related to the Metland Travelmate Program or improper, fraudulent or deceptive use of the card, Points, Benefits, submission of false information and/or harmful or objectionable behavior of the Member or any person accompanying him/her (in particular, regrettable, malicious or insulting behavior towards the Hotel staff, the Member, the Member's service personnel or any other person related to the services, benefits or other advantages offered by the Hotel or by Metland Hotels Group), including during activities organized as part of the Program, may result – at the sole discretion of Metland Hotels Group – in the temporary suspension of the Program membership or termination of the Member without notice or compensation, and in the cancellation of Points earned by the Member with his/her card, in accordance with the provisions set out in Article 12.5. This suspension or termination shall not prejudice the right of Metland Hotels Group to take action against the Member.
You are responsible for keeping your membership information current and notifying us of any changes to your membership information. Name changes must be supported by legal documentation, including, for example, a valid marriage certificate, driver's license, or court document. We are not responsible for any incorrect or inaccurate information provided by any Member. Registration and account creation are subject to verification by us in our sole discretion. We also reserve the right to verify information collected during Program registration or provided during participation in the Program and, in our sole discretion, suspend or terminate any account and prohibit participation in the Program by any individual or email address associated with or suspected of being associated with fraudulent activity, including, without limitation, registering for multiple accounts.
You may only enroll another individual in the Program if you are authorized by that individual to take such action on their behalf (e.g., a travel agent who has been authorized by their client). The person you enroll must meet all eligibility requirements for the Program and must not have another Program account. If you enroll another individual in the Program, you accept these Terms and Conditions on that individual's behalf, and you represent and warrant that you are authorized by that individual to bind them to these Terms and Conditions as if they themselves were enrolling in the Program. In such event, you agree that you have shared these Terms and Conditions with that individual. If you are an individual who has been enrolled in the Program by a third party, you understand that your participation in the Program is subject to these Terms and Conditions and you agree to these Terms.
Without limiting the generality of the foregoing, if you attempt to register another person in the Program, We reserve the right to request verification from you and/or the person you propose to register. If the information provided is insufficient to verify the validity of your authorization and/or the validity of the new account or member, as determined by Us in its sole discretion, We reserve the right to not open, suspend, or terminate your account, the new account, or both.

9.1.5.1
Make a booking
transaction via the Platformmhg.idand Food &
Beverage (F&B) transactions at the Hotel to achieve Tier Membership to get
Benefits according to Tier;
9.1.5.2
Collecting
Points from room booking transactions through the Platformmhg.id, Food & Beverage
(F&B) and Banquet transactions at Hotels;
9.1.5.3
Exchange
Points for Travelmate E-vouchers, Merchant E-Vouchers, direct room discounts
and/or various other options to be used on the Platformmhg.id;
9.1.5.4
Collect
accumulated online booking transactions through the mhg.id Platform for 10
nights and or 10 rooms within a certain period for the Complimentary Stay
Program at Metland Hotels Group.
9.1.6
Tier
Achievement Procedures:
9.1.6.1
Members can
reach a higher Tier by making room booking transactions through the Platform.mhg.id, and Food & Beverage (F&B) transactions at the
Hotel, and prices do not include tax and service charges.
9.1.6.2
Tier
Achievement will be calculated after Member Check-Out, with a maximum
validation period of H+3 (within three working days).
9.1.6.3
The Tier
validity period is 3 years or 1095 consecutive days from the date you make a
room reservation through the platform.mhg.id, Food & Beverage and
Banquet at Hotel.
9.1.6.4
To maintain
the Tier and its Benefits, Members must make at least one Transaction before
the Tier period ends.
9.1.6.5
The Tier
Transaction calculation will be reset to 0 at the start of the new period if
the Member does not make any Transactions during the validity period of the
Tier period in accordance with the provisions contained in Article 8.2.3.
9.1.6.6
Tier levels
will not be affected or changed by Redeem Points.
9.2.
How to Earn Travelmate Points:
9.2.1
Points are
obtained from Member transactions that make room reservations through the
platform.mhg.id, Food & Beverage at Hotel and Banquet from the total
bill/receipt (excluding tax & service charges).
9.2.2
Each
transaction receipt/bill that has been posted by the hotel staff will earn
Points according to the value in the Points conversion table (applies to
multiples and bill combinations).
9.2.3
Members
collect points from transaction bills/receipts, which are posted on the same
day as the transaction at the hotel. The bill/receipt posting process is
carried out by hotel staff after the member checks out, with a maximum
validation period of H+3 (within three business days).
9.2.4
If the
application of the Points scale results in Points with decimal fractions, the
number of Points credited will be the next lowest whole number if the number
after the decimal point is lower than five and the next highest number if the
decimal is equal to or higher than five.
9.2.5
Travelmate
Points are valid for 3 years or 1095 consecutive days from the time the
Transaction is declared to meet the terms and conditions for obtaining Points
and the Points are credited to the Travelmate Member account.
9.2.6 At the end of the validity period, Travelmate Points in the Member's account will expire.
9.3.
The procedure for exchanging
Travelmate Points is explained as follows:
9.3.1
Points can be
used as room discounts for online bookings via the mhg.id platform.
9.3.2
Points that
have been used as a discount when booking a room through the mhg.id platform
cannot be refunded, even if cancellation occurs either before or after payment
is made.
9.3.3
Collected
points can be exchanged for Metland Travelmate E-vouchers worth IDR 50,000 and
IDR 100,000, Merchant E-Vouchers and several other options.
9.3.4 Points exchanged in the form of Merchant E-Voucher options through the Platform, the validity period of the Merchant E-Voucher is 30 (thirty) days from the date of point exchange or otherwise determined by the policy maker. And any Merchant E-Voucher that has been exchanged but has not been used by the Member when the validity period ends, the number of points will still be deducted according to the number of Merchant E-Voucher exchange requests.
9.4.
The procedure for using the
Travelmate E-Voucher is explained as follows:
9.4.1
Travelmate
e-Vouchers can be used to pay for room reservations via the mhg.id platform.
9.4.2
The validity
period of the Travelmate E-voucher is 3 (three) months or 90 (ninety) days from
the date of point exchange/redeem.
9.4.3 Payment transactions with Travelmate E-vouchers cannot be counted towards Points and Tier achievements.
9.5.
The procedure for using the
Metland E-Voucher owned by Metland Card Members on the Travelmate Service is
explained as follows:
9.5.1
Metland Card
members must connect their Metland Travelmate account with their Metland Card
from the Member profile page on the mhg.id platform.
9.5.2 Metland Card members can follow the account connection process steps on the mhg.id platform.
9.5.3
Metland
e-vouchers can be used to pay for room reservations through the mhg.id
platform, and for payments for Food and Beverage (F&B) reservations at the
hotel.
9.5.4
The validity
period of the Metland E-voucher is 1 (one) month or 30 (thirty) days calculated
from the date of exchange/redeem of points via the Metland Card application.
9.5.5 Payment transactions using Metland E-vouchers cannot be counted as additional Points and Tier achievements.
9.6
The program
benefits provided to Metland Travelmate members are based on the tier level
achieved at the time of booking. Tier membership benefits are detailed in the
Member Account Profile menu on the mhg.id platform, with the following
provisions:
9.6.1
Special Member
Rates are the published prices of the mhg.id platform with special discounts
given to all Tier Member levels, which are explained as follows:
9.6.2
Members must
make hotel room reservations through the mhg.id platform.
9.6.3
Special Member
Rates are a discount of 2% to 10% of the room rate including tax and service
charges, and are adjusted to the availability of rooms at the hotel on the
selected date.
9.6.4 Special Member
Rates can also be used in conjunction with other promotions or special offers,
subject to applicable terms and conditions.
9.6.5 Online Check
In Offers is a Benefit for all Tier Members that offers an online Check-in
process through the Metland Travelmate CRM platform with the following
conditions;
9.6.5.1
The Online
Check In Benefit is in the form of an offer sent via email after a Member makes
a room booking transaction via the mhg.id Platform.
9.6.5.2
Members can enjoy Benefits and
follow the Online Check-in process as well as the Terms and Conditions
explained via E-mail.
9.6.5.3 This benefit can only be enjoyed at the Horison Ultima Seminyak Hotel and Metland Venya Ubut
9.6.6
The
Complimentary Stay Program (Coming Soon 2026) is a complimentary stay benefit
after a certain number of accumulated stays. The Complimentary Stay Program
redemption procedure is explained below:
9.6.6.1
Members must make booking
transactions online via the Platform.mhg.idfor 10 nights and or 10 rooms in all
Metland Hotels Group networks within a certain period and does not apply to
room bookings through other platforms.
9.6.6.2
The program period is calculated
for 365 days from the first online booking transaction.
9.6.6.3
At the end of the period, the
Program will expire if the Member does not achieve the accumulated stays
according to the provisions in Article 9.2.6 and the accumulated calculation of
previous transactions will be returned to 0 nights or 0 rooms.
9.6.6.4
Calculation of stay per night
and/or room will apply after the Transaction meets the Terms and Conditions at
the time of Member Check Out with a maximum validation period of H+3 (within
three working days).
9.6.6.5
After reaching 10 nights stay and
or rooms (accumulative), Members are entitled to 1 night Complimentary Stay
Voucher.
9.6.6.6
Nominal 1 Complimentary Stay
E-Voucher worth the average price of the accumulation of 10 nights and or 10
rooms from room bookings in all Metland Hotels Group networks through the
mhg.id platform.
9.6.6.7
Complimentary Stay E-Voucher can
be used throughout the Metland Hotels Group network according to room
availability and prices applicable on the date of room booking through the
mhg.id Platform.
9.6.7
Members in the Preferred and
Luxury Tiers will receive the Benefit Program; Late Check-out or Early Check-in
and Room Upgrades, which will be explained as follows:
9.6.7.1
Late Check-out or Early Check-in
can be selected and depends on the availability of hotel rooms on that date.
9.6.7.2
Room Upgrades are subject to Hotel
room availability on that date.
9.6.7.3
Late Check-out is no later than
16.00 local time.
9.6.7.4
The earliest Early Check-In is at
10.00 local time.
9.6.7.5
Members can take advantage of this
benefit by booking a room through the platformmhg.idand include a note in the “Special
Request” column.
9.6.7.6 The hotel will confirm room availability during the check-in reservation process at the hotel.
9.6.8
F&B Discount is a benefit
program offered to Members according to Tier, with the following conditions:
9.6.8.1
Premium Tier gets a 10% F&B
discount, Preferred Tier gets a 15% F&B discount and Luxury Tier gets a 20%
F&B discount;
9.6.8.2
Discount calculation is the value
of the total transaction including tax and service charges;
9.6.8.3
F&B discounts only apply at
the Hotel restaurant outlet and do not apply to Banquets;
9.6.8.4 Members will be provided with all information at the Hotel.
9.7 Hotel-Specific
Benefits (eXcare) provided to Metland Travelmate Members are based on the Tier
level achieved at the time of booking. Tier membership benefits are detailed in
the Member Account Profile menu on the mhg.id platform, with the following
provisions:
9.7.1
Benefit Car Window Cleaning pada
Tier Premium, Preferred, Luxury:
9.7.1.1
Benefit in the form of cleaning of
Member's car windows upon arrival at each stay;
9.7.1.2
This benefit only applies to
Members who make reservations and stay at the Hotel;
9.7.1.3
If the Member's stay is more than
one night, it will be considered as one stay;
9.7.1.4
Members are required to provide
the license plate number of the car they wish to receive this benefit;
9.7.1.5
The number of cars that receive
this benefit follows the Hotel Management policy.
9.7.2
Benefit Welcome Drink pada Tier
Premium, Preferred, Luxury. Welcome Fruit or Snack pada Tier Preferred dan
Luxury:
9.7.2.1
This benefit only applies to
Members who make reservations and stay at the Hotel;
9.7.2.2
Benefits in the form of physical
vouchers given to Members upon arrival at each stay;
9.7.2.3
Vouchers can be exchanged directly
in the Hotel Reservations section;
9.7.2.4
If a Member Checks in and Checks
out on the same day at the same Hotel it will be considered as one stay;
9.7.2.5
If the Member's stay is more than

Benefits in the form of physical
vouchers given to Members upon arrival at each stay;
9.7.3.4
If a Member Checks in and Checks
out on the same day at the same Hotel it will be considered as one stay;
9.7.3.5
If the Member's stay is more than
one night, it will be considered as one stay and will not receive an additional
voucher;
9.7.3.6
Shoe cleaning methods follow Hotel
Management policies.
9.7.4
Priority Welcome Benefit on the
Luxury tier:
9.7.4.1
Benefits in the form of priority
access during check-in at the reservation desk given to members at the Luxury
Tier level;
9.7.4.2
This benefit only applies to
Members who make reservations and stay at the Hotel;
9.7.4.3
at check-in;
9.7.4.4 Other provisions regarding the Priority Welcome Benefit follow Hotel Management policy.
9.8
Others
9.8.1
Any Points, E-Vouchers,
Complimentary Stay Vouchers and Benefits that you receive cannot be claimed or
exchanged for money, either through us or any other party, or transferred or
assigned to any other party, either by transfer or cashing, or in any other
way.
9.8.2
We have the right to validate all
transactions that are considered doubtful and reject all transactions whose
validity is in doubt.
9.8.3
We have the right to take relevant
legal steps against Members in accordance with applicable laws and/or
regulations if we find fraud in posting Points, using E-Vouchers, including if
Members obtain Points in an unfair manner, including downloading fake shopping
receipts/receipts, duplicated receipts, etc., and Members are required to
replace/refund the total amount of the loss.
9.8.4
Transactions that can be counted
towards Tier achievement and Points exchange are Transactions that meet the
following conditions:
9.8.4.1
Member transactions that make room
reservations through the platformmhg.id, Food & Beverage at Hotel and
Banquet from the total bill/receipt.
9.8.4.2
Cancelled booking transactions
will not be counted as points except for transactionsnon-refundable And no-show.
9.8.4.3
Transactions will be calculated
after the Member Checks Out from the Hotel.
9.8.4.4
Payment transactions outside the
use of E-Vouchers/Direct Discounts/Complimentary Stay E-Vouchers.
9.8.5
We have the right to reject and
not process transactions that do not meet the provisions of Article 9.3.4
above.
9.8.6
We reserve the right to correct
the number of points entered without prior notice if:
9.8.6.1
The transaction does not comply
with the terms and conditions in Article 8.9.4 above.
9.8.6.2
Data verification error by us.
9.8.7
If there are any complaints
regarding the calculation of Points, Members can contact us.
9.8.8
We are not responsible for any
misuse of Metland Travelmate Member Accounts by other parties.
9.8.9
We have the right to verify and
clarify all transactions using E-vouchers whose validity is deemed doubtful, by
having the right to ask Members to show proof of payment transactions if
necessary.
9.8.10 By participating in this program, Members are deemed to have agreed to all applicable provisions in the Metland Travelmate Program.

Changes to
these Terms and Conditions; Program Modifications
10.1
Changes to
These Terms and Conditions. We reserve the right to change these Terms and
Conditions from time to time, with reasonable notice to Members as described in
this section. We will notify you of changes to the Terms and Conditions by
posting them on the Program website and may also notify you by email or mail to
the address associated with your account. The updated Terms and Conditions will
be effective from the time they are posted, or on a later date or by such other
method as We may determine. Unless otherwise stated, the updated Terms and
Conditions will apply to your participation in the Program from the date they
become effective. These Terms and Conditions may only be changed in accordance
with this section. Otherwise, no employee, agent, or representative of Us or
any of Our Parties has the right or authority to change these Terms and
Conditions.
10.2
Program
Modifications. We reserve the right, from time to time, to, among other things:
change earning capabilities; withdraw, limit, modify, or cancel any rewards or
benefits; cancel or modify any rewards or partner programs; add or modify
points or other requirements for earning rewards or benefits; modify or
regulate the transfer of points, rewards, or benefits; change membership tiers
or the benefits available for each tier; add blackout dates; or limit the
number of rooms available for award redemption in any or all destinations. We
may limit the number of Program participants and may temporarily or permanently
discontinue new Member registrations at any time and for any reason without
notice.
10.3
We are not
responsible for any partner withdrawal from the Program, changes to partner
services, or issues related to the earning or use of points or rewards caused
by any partner withdrawal.
10.4
This program
may contain outbound linksto other
websites operated by Us. When using these websites, Members must agree to
separate terms and conditions, which may differ from these Terms and
Conditions.

Prohibition
11.1 By
accessing and using this Program, Members are deemed to have agreed to the
Terms and Conditions.
11.2 In using
the Program, Members may not engage in any of the following actions:
11.2.1
Any act of
violation of the property or privacy, etc., of Us and/or any third party, or
taking any action that may cause such violation.
11.2.2
Any action
that causes loss or damage to Us and/or third parties.
11.2.3
Any unlawful
act such as the collection, disclosure, falsification or deletion of Our and/or
third party information (including, among others, registered information, usage
history information and other information), or any action that may cause this.
11.2.4
Any action
that accesses the Program (including servers and networks connected to the
Program) without permission or in any other way in an unlawful manner, or any
other action that hinders its use or operation, or any action that may cause
this, including actions in connection with it that cause losses to Us and/or
third parties.
11.2.5
Any act that
violates public order, decency or morals, or any act that may cause such.
11.2.6
Any unlawful
act or act related to an unlawful act, or act that may lead to such.
11.2.7
Any act of
false statement or declaration or submission including providing false or
misleading information.
11.2.8
Any action
using the Program to gain an advantage inconsistent with the purpose of this
Program, or any action in preparation for such.
11.2.9
Any action
that defames or damages our good name and/or any third party.
11.2.10
Any action
that uses or provides destructive programs such as computer viruses or other
software destructive programs (including but not limited to malware, Trojan
horses, etc.) or any action that may cause this.
11.2.11
Any act of
using the Program by pretending to be a third party.
11.2.12
Any action
that violates the Terms and Conditions, and the Privacy Policy, or any action
that may lead to this.
11.2.13
Any action
that violates laws and regulations both at home and abroad, any action that may
cause this, or any action that violates legally binding administrative actions.
11.2.14
Any other
action that is deemed inappropriate by Us and/or results in Us being liable,
either directly or indirectly.
11.2.15 We reserve the right to take relevant legal steps against Members in any violation of the above prohibitions in accordance with applicable laws and/or regulations.
12
Limitation of
Liability
12.1
We provide
this Program as is, always striving for the best possible quality and security.
However, we do not guarantee that the Program is completely free fromerror, bug, interference, damage or other defects.
12.2
We make no
guarantees regarding the accuracy, timeliness, usefulness, or other
characteristics of the information published in the Program. We may, in our
sole discretion, add, change, correct, or delete information published in the
Program at any time without prior notice to Members, to the extent permitted by
applicable laws and/or regulations. If the addition, change, correction, or
deletion of Program information causes losses to Members, the provisions of
Article 14 shall apply.
12.3
We may, in Our
sole discretion, suspend or discontinue the Services or the display of the
Program in whole or in part, for reasons including, but not limited to, the
following:
12.3.1
In the event
of periodic maintenance or care or emergency or upgrade of equipment and
systems for Program publication.
12.3.2
In the event that the service or
appearance of the Program is difficult to implement due to matters beyond Our
control such as fire, power outage, natural disaster, state of war or
civil/military emergency, telecommunications disruption (including internet
network outage) and so on which are beyond Our control.
12.3.3
In case the
telecommunications services are not provided by the telecommunications
operator.
12.3.4
When We have determined that
temporary suspension or termination of the Program is necessary for operational
or technical reasons, or We have determined that due to unforeseen
circumstances, the service or performance of the Program is too difficult to carry
out.
12.3.5
In the event of an order from the
authorized apparatus and/or a court decision based on applicable laws and/or
regulations.
12.3.6
In the event that We have reason
to believe that a credible cyber attack or security breach of the system has
occurred, is occurring, or will occur in the near future.
12.4
In the event
that any loss or damage occurs to a Member or a third party due to the
temporary suspension or termination of the Service or the performance of the
Program, the provisions of Article 14 shall apply.
12.5
Members can
terminate their use by deleting the Membership Account that has been registered
and accessed on the device used.
12.6
Even if a
Member terminates their use of the Program, the Member's information obtained
through the Program will not be deleted. The handling of such Member
information will be adjusted and treated in accordance with the provisions of
the Privacy Policy and applicable laws and/or regulations regarding personal
data.
12.7
If a Member
violates the provisions of the Terms and Conditions, We reserve the right to
revoke or temporarily suspend the Member's rights under the Terms and
Conditions and the Member's right to use the Program without prior notice to
the Member. We will not be liable for any loss or damage incurred by the Member
as a result of Us exercising the rights stated in this article. For the purpose
of terminating the Member's rights above, the parties agree to disregard
Article 1266 of the Civil Code.
12.8 In the event that a link from the Program refers to a third-party website or application, We will not be responsible for any third-party website or application other than this Program. In such circumstances, We will not be responsible for the content, advertisements, products, services, etc., including the content or content in the third-party website or application and that is available for use of the third-party website or application, including the actions of Members on the third-party website or application. We will not be responsible for providing compensation for damages caused by or occurring in connection with any content, advertisements, products, services, etc., which are not products of Us and/or Management. By providing links or providing access to third-party websites or applications, We do not provide any representations, warranties or endorsements, express or implied, regarding the legality, accuracy, quality or authenticity of the content, information or services provided by the third-party website or application.

Trademark /
Intellectual Property Rights
Members may not copy, reproduce, distribute, transmit, broadcast, display, sell, license or exploit any Trademarks contained in the Program for any purpose.
14
Compensation
14.1 We will not be
responsible for any damage or loss whatsoever that occurs to Members or third
parties related to changes, disruptions, suspensions, terminations or
terminations and so on in the Program to the extent permitted by applicable
laws and/or regulations.
14.2 We will not be
responsible for damage caused by certain events or incidents that are beyond
our control or are of a force majeure nature or due to forced circumstances as
long as it is permitted by applicable laws and/or regulations.
14.3 In the event
that a Member causes damage and/or loss to a third party in connection with the
use of the Program, the Member shall be responsible for resolving such damage
and/or loss at the Member's expense and shall not hold Us responsible for any
actions taken by the Member himself. In the event that a Member causes damage
and/or loss to Us through actions that violate the Terms and Conditions and
applicable laws and/or regulations, We may request compensation or equivalent
compensation for the damage and/or loss caused by the Member, including taking
legal steps against the Member as a result of the actions taken.
14.4 To the extent
permitted by applicable law and/or regulations, Members agree to defend,
indemnify and hold harmless Us, our shareholders, sponsors, business partners,
directors, commissioners, employees and agents, from and against any and all
claims, damages, obligations, losses, liabilities, costs or debts and expenses
(including, but not limited to, legal advisory fees) arising from:
(i)
Member's use
or access to our services caused by Member's negligence
(ii)
Violation of
these Terms and Conditions; and/or
(iii) Violations by Members against third parties
15 Personal data
15.1
Members agree
that We may obtain, store, manage, use and transfer your personal data for the
purpose of providing Services in this Program.
15.2 Management of personal data must be carried out properly in accordance with the Privacy Policy determined separately by Us.
16
Separability
If one or more provisions of these Terms and Conditions are declared invalid,
void or unenforceable, such provision shall be deemed severable and shall not
affect the validity and/or enforceability of the remaining provisions of these
Terms and Conditions which shall remain in full force and effect.
17 Entire Agreement
These Terms and Conditions constitute the complete and exclusive agreement between you and us regarding the Program. They supersede all prior or contemporaneous communications, agreements, advertisements, and proposals, whether electronic, oral, or written, relating to this Program or any other version of our or our Party's customer loyalty program. Neither you nor we acknowledge that neither of you was induced to agree to these Terms and Conditions by any representation or promise not expressly stated in these Terms and Conditions.
18 Applicable Law
These Terms and
Conditions are governed by Indonesian Law.
19 Dispute Resolution
Any dispute arising out of or in connection with these Terms and Conditions, including but not limited to any question as to their existence, validity or termination, which cannot be resolved amicably, shall be resolved through the Courts.
20
Language
If there is any discrepancy or inconsistency between the English version and the Indonesian version of these Terms and Conditions, the Indonesian version shall prevail, govern and control.

You agree to receive all communications, including notices, agreements,
disclosures, and other information from us or by uploading it to features

SYARAT & KETENTUAN PENGGUNAAN
PROGRAM METLAND TRAVELMATE
Program Loyalitas Metland Travelmate (selanjutnya disebut sebagai “Program”) dipersembahkan oleh PT Metropolitan Land Tbk beserta anak perusahaan dan afiliasinya (“Kami”).
Dengan bergabung pada Program ini, maka Anda dianggap telah membaca, memahami, dan secara sadar dan tanpa paksaan menyetujui Syarat dan Ketentuan Program Loyalitas Metland Travelmate (“Syarat dan Ketentuan”) ini. Kami mengumpulkan dan menggunakan informasi pribadi Anda sesuai dengan Kebijakan Privasi kami.
2.1. “Member” atau “Anda” adalah individu yang memenuhi syarat untuk mendaftar dan terdaftar dalam program keanggotaan Metland Travelmate dan telah menyetujui syarat dan ketentuan keanggotaan Program.
2.2. “Platform” adalah situs resmi www.mhg.id dan aplikasi resmi Metland Hotels Group.
2.3. “Transaksi” adalah kegiatan yang dilakukan Member untuk mendapatkan poin dan pencapaian tier.
2.4. “Poin” adalah unit nilai loyalitas yang diperoleh Member dari transaksi yang memenuhi syarat, dengan konversi poin yang berbeda sesuai tabel berikut:

2.7. “E-Voucher” berarti kupon/voucher yang diperoleh dari penukaran poin melalui Platform yang berlaku sebagai alat pembayaran di Hotel, dengan masa berlaku selama 3 (tiga) bulan atau 90 (sembilan puluh) hari dari tanggal penukaran poin.
2.8. “Hotel” berarti hotel yang dibangun dan dikembangkan atau dikelola oleh Metland Hotels Group, antara lain Hotel Horison Ultima Bekasi, Metland Smara Kertajati, Hotel Horison Ultima Seminyak Bali, Metland Hotel Bekasi, Metland Hotel Cirebon, dan Metland Venya Ubud, termasuk hotel-hotel yang akan dibangun dan/atau dikembangkan kemudian.
2.9. “Check-in” adalah tanggal kedatangan di Hotel.
2.10. “Check-out” adalah tanggal keberangkatan dari Hotel.
2.11. “Merchant” adalah merchant rekanan/mitra Metland Hotels Group sebagai pihak yang memperjual atau belikan jasa dan atau produk yang dapat ditukar dengan E-Voucher atau konten promosi lainnya.
2.12. “Promosi” adalah layanan dari program promo penjualan yang berisikan konten yang ditawarkan kepada Member.
Hotel-hotel yang berpartisipasi dalam Program ini adalah hotel-hotel yang beroperasi di bawah jaringan Metland Hotels Group.
Ketika sebuah hotel atau merek bergabung dengan jaringan Metland Hotels Group atau mendaftar dalam Program sebagai hotel yang berpartisipasi, Member hanya akan dapat memperoleh Poin dan menikmati manfaat terkait Program lainnya pada masa inap yang memenuhi syarat yang diselesaikan di hotel yang dimaksud setelah kegiatan ini.
Jika sebuah hotel meninggalkan jaringan Metland Hotels Group atau berhenti menjadi hotel yang berpartisipasi setelah Member melakukan pemesanan tetapi sebelum masa inap Member yang sebenarnya, maka ketentuan yang berlaku untuk Member sebagai berikut:
a. Tidak akan memperoleh Poin dan tidak akan memiliki akses ke layanan atau manfaat apa pun selama menginap di hotel tersebut.
b. Tidak akan memiliki akses ke penawaran khusus apa pun yang mungkin diikuti oleh hotel tersebut.
Metland Hotels Group akan melakukan segala upaya untuk memberikan pemberitahuan yang wajar kepada Member yang terkena dampak sebelum Member menginap.
Program ini terbuka untuk individu yang secara hukum dianggap dewasa atau memiliki kapasitas hukum untuk menandatangani kontrak di negara asal Member.
Member memiliki kartu keanggotaan “E-Card”, yang dikirimkan kepada mereka sebagai kartu yang tersedia secara elektronik, tergantung pada Tier Member. Kartu keanggotaan bersifat nominatif dan sepenuhnya bersifat pribadi. Kartu tersebut tidak dapat dijual, dipinjamkan, atau dipindahtangankan. Kartu keanggotaan bukanlah alat pembayaran dan tidak dapat digunakan untuk menjamin pemesanan. Kartu tersebut mencantumkan nama Member, nomor identifikasi, dan tanggal kedaluwarsa Tier. Aturannya adalah satu kartu keanggotaan Metland Travelmate per Member. Kartu tersebut hanya dapat digunakan oleh Member yang namanya tercetak pada kartu (E-Card).
Alamat email individu yang valid diperlukan untuk bergabung dengan Program. Dua atau lebih individu tidak boleh menggunakan alamat email yang sama. Dengan bergabung dalam Program, Member setuju untuk menerima komunikasi elektronik yang berkaitan dengan pengoperasian dan layanan yang ditawarkan oleh Program, termasuk pesan informasi, pernyataan Poin, dan informasi mengenai pengoperasian akun Member. Jika Member tidak lagi ingin menerima informasi ini, yang dianggap penting untuk pengoperasian Program, Member harus mengikuti ketentuan penghentian Program yang ditetapkan dalam Pasal 12.5.
Member menyetujui bahwa Program dapat diubah, baik seluruhnya atau sebagian, sewaktu-waktu. Dalam jangka waktu yang wajar sebelum pengajuan, Member memiliki kemungkinan untuk mengakhiri keanggotaan mereka sebagaimana diuraikan dalam Pasal 12.5. Partisipasi dalam Program setelah tanggal efektif perubahan menyiratkan penerimaan di pihak Member.
Untuk mendaftar dalam Program, Anda harus membuat akun Member dengan mengisi informasi yang diperlukan dalam formulir pendaftaran, termasuk nama pengguna (‘Nama Pengguna’). Member menyatakan bahwa informasi yang diberikan dalam formulir pendaftaran atau yang dikirim ke Metland Hotels Group adalah benar dan lengkap. Metland Hotels Group tidak bertanggung jawab jika terdapat kesalahan atau informasi yang tidak benar/valid yang diberikan oleh Member, dan sebagai akibatnya, Metland Hotels Group tidak dapat memberikan Member pengalaman Program yang lengkap sebagaimana dijelaskan disini.
5.1. Registrasi
Registrasi berarti sebuah proses dimana Anda ingin mendaftarkan diri pada Program dan menjadi Member. Proses registrasi diatur sebagai berikut:
5.1.1. Batas minimal usia untuk mendaftarkan diri sebagai Member adalah 18 tahun pada saat mendaftar.
5.1.2. Anda diminta untuk mendaftarkan email, satu nomor handphone. Satu kartu identitas hanya berlaku untuk satu akun.
5.1.3. Jika nomor handphone dan alamat email yang digunakan belum terdaftar pada Program, maka Anda akan diarahkan untuk melakukan proses pendaftaran terlebih dahulu, dengan mengisi data nama, alamat email dan nomor handphone, kemudian Anda akan mendapatkan verifikasi kode OTP yang akan dikirimkan sesuai alamat email yang sudah terdaftar atas nomor handphone tersebut.
5.1.4. Setelah proses verifikasi kode OTP berhasil, maka Anda diarahkan untuk membuat Password dan Konfirmasi Password.
5.1.5. Kemudian Anda akan mendapatkan nomor Member Metland Travelmate yang akan dikirimkan sesuai alamat email yang didaftarkan pada Program.
5.1.6. Anda sudah dapat melakukan proses login dengan menggunakan email atau nomor handphone yang telah diinformasikan melalui email.
5.2. Login
Login adalah sebuah proses dimana Anda telah terdaftar menjadi Member dan ingin menggunakan Program. Pada halaman Login, Member dapat menggunakan email atau nomor handphone yang sama dengan yang digunakan pada Platform. Hal ini bertujuan untuk melanjutkan data dan progress yang sudah ada pada Platform.
5.3. Dengan menggunakan akun, Member dapat:
5.3.1. Mengetahui total akumulasi malam (room nights) atau total kamar (rooms), jumlah poin, akumulasi transaksi, riwayat transaksi, tingkatan tier member dan benefit.
5.3.2. Dikenali di situs web mhg.id atau layanan seluler.
5.3.3. Mengetahui riwayat reservasi dan reservasi saat ini.
5.3.4. Akses penawaran dan layanan yang dipersonalisasi.
Akun Member bersifat sangat pribadi dan rahasia. Member bertanggung jawab penuh untuk menyimpan dan menggunakannya. Metland Hotels Group tidak bertanggung jawab kepada Member atas segala kerugian yang dialami karena adanya kesalahan dan penyalahgunaan akses akun Member yang tidak sah, curang, atau tidak pantas.
Anda bertanggung jawab sepenuhnya untuk menjaga kerahasiaan kata sandi, nomor keanggotaan, dan informasi akses akun lainnya serta untuk membatasi akses ke perangkat dan akun Anda, termasuk, tanpa batasan, akun email apa pun yang terkait dengan akun Anda atau masa inap Hotel, sehingga orang lain tidak dapat mengakses akun Anda, dan Kami tidak akan bertanggung jawab atas kegagalan Anda untuk melakukannya.
Setiap pelanggaran oleh Member terhadap Syarat dan Ketentuan ini, wanprestasi pembayaran (tagihan hotel, faktur, atau komitmen lainnya) sehubungan dengan barang atau layanan yang ditawarkan oleh Hotel, Metland Hotels Group atau mitra mereka atau yang terkait dengan Program Metland Travelmate atau penggunaan kartu, Poin, Benefit secara tidak benar, curang atau penipuan, penyampaian informasi palsu dan/atau perilaku merugikan atau tidak menyenangkan dari Member atau siapa pun yang menyertainya (khususnya, perilaku yang disesalkan, jahat atau menghina terhadap staf Hotel, Member, personel layanan Member, atau orang lain yang terkait dengan layanan, manfaat atau keuntungan lain yang ditawarkan oleh Hotel atau oleh Metland Hotels Group), termasuk selama kegiatan yang diselenggarakan sebagai bagian dari Program, dapat mengakibatkan – atas kebijakan Metland Hotels Group – penangguhan sementara keanggotaan Program atau penghentian Member tanpa pemberitahuan atau kompensasi, dan pembatalan Poin yang diperoleh Member dengan kartunya, sesuai dengan ketentuan yang ditetapkan dalam Pasal 12.5. Penangguhan atau penghentian ini tidak akan merugikan hak Metland Hotels Group untuk mengambil tindakan terhadap Member.
Anda bertanggung jawab untuk menjaga informasi keanggotaan Anda tetap terkini dan memberi tahu Kami tentang setiap perubahan pada informasi keanggotaan Anda. Perubahan nama harus didukung oleh dokumentasi hukum, termasuk, misalnya, surat nikah, SIM, atau dokumen pengadilan yang sah. Kami tidak bertanggung jawab atas informasi yang salah atau tidak akurat yang diberikan oleh Member mana pun. Pendaftaran dan pembuatan akun tunduk pada verifikasi oleh Kami atas kebijakannya sendiri. Kami juga berhak untuk memverifikasi informasi yang dikumpulkan selama pendaftaran Program atau yang diberikan selama partisipasi dalam Program dan, atas kebijakannya sendiri, menangguhkan atau menghentikan akun apa pun dan melarang partisipasi Program oleh individu atau alamat email mana pun yang terkait dengan atau diduga terkait dengan aktivitas penipuan, termasuk, tanpa batasan, mendaftar untuk beberapa akun.
Anda hanya dapat mendaftarkan individu lain dalam Program ini jika Anda diberi wewenang oleh individu tersebut untuk mengambil tindakan tersebut atas nama mereka (misalnya, agen perjalanan yang telah diberi wewenang oleh klien mereka). Orang yang Anda daftarkan harus memenuhi semua persyaratan kelayakan untuk Program dan tidak boleh memiliki akun Program lain. Jika Anda mendaftarkan individu lain dalam Program, Anda menerima Syarat dan Ketentuan ini atas nama orang tersebut, dan Anda menyatakan dan menjamin bahwa Anda diberi wewenang oleh individu tersebut untuk mengikat mereka pada Syarat dan Ketentuan ini seolah-olah mereka sendiri yang mendaftar dalam Program. Dalam hal tersebut, Anda setuju bahwa Anda telah membagikan Syarat dan Ketentuan ini dengan individu tersebut. Jika Anda adalah individu yang telah didaftarkan dalam Program oleh pihak ketiga, Anda memahami bahwa partisipasi Anda dalam Program tunduk pada Ketentuan ini dan Anda menyetujui Ketentuan ini.
Tanpa membatasi ketentuan umum di atas, jika Anda mencoba mendaftarkan orang lain dalam Program, Kami berhak meminta verifikasi dari Anda dan/atau orang yang Anda usulkan untuk didaftarkan. Jika informasi yang diberikan tidak mencukupi untuk memverifikasi keabsahan otorisasi Anda dan/atau keabsahan akun atau anggota baru, sebagaimana ditentukan oleh Kami atas kebijakannya sendiri, kami berhak untuk tidak membuka, menangguhkan, atau menghentikan akun Anda, akun baru, atau keduanya.
9.1. Layanan Program Metland Travelmate terdiri atas:
9.1.1 Informasi tentang Program dan Layanan dari Kami, Manajemen atau perusahaan-perusahaan yang bekerjasama dengan Manajemen.
9.1.2 Informasi mengenai promo penjualan, acara (event) dan kampanye Program atau jasa yang disediakan Manajemen.
9.1.3 Informasi tentang Program dan berbagai macam Layanan lainnya yang ditawarkan
9.1.4 Informasi yang disarankan.
9.1.5 Program Metland Travelmate yang dapat diikuti oleh Member, dimana Member dapat;
9.1.5.1 Melakukan Transaksi booking melalui Platform mhg.id dan transaksi Food & Beverage (F&B) di Hotel untuk mencapai Tier Membership untuk mendapatkan Benefit sesuai Tier;
9.1.5.2 Mengumpulkan Poin dari transaksi booking kamar melalui Platform mhg.id, transaksi Food & Beverage (F&B) dan Banquet di Hotel;
9.1.5.3 Menukarkan Poin menjadi E-voucher Travelmate, E-Voucher Merchant, diskon langsung kamar dan atau berbagai pilihan lainnya untuk dapat digunakan di Platform mhg.id;
9.1.5.4 Mengumpulkan akumulasi transaksi booking secara online melalui Platform mhg.id selama 10 malam dan atau 10 kamar dalam periode tertentu untuk Complimentary Stay Program di Metland Hotels Group.
9.1.6 Tata Cara Pencapaian Tier:
9.1.6.1 Member dapat mencapai Tier lebih tinggi dengan melakukan transaksi pemesanan kamar melalui Platform mhg.id, dan transaksi Food & Beverage (F&B) di Hotel, serta harga tidak termasuk biaya pajak dan pelayanan (tax dan services charge).
9.1.6.2 Pencapaian Tier akan dihitung setelah Member Check-Out, dengan masa validasi maksimal H+3 (dalam waktu tiga hari kerja).
9.1.6.3 Periode berlaku Tier adalah 3 tahun atau 1095 hari berturut-turut sejak Anda melakukan pemesanan kamar melalui platform mhg.id, Food & Beverage dan Banquet di Hotel.
9.1.6.4 Untuk mempertahankan Tier dan Benefitnya, Member harus melakukan minimal satu kali Transaksi sebelum masa periode Tier berakhir.
9.1.6.5 Penghitungan Transaksi Tier akan diatur ulang ke nominal 0 pada awal periode baru jika Member tidak melakukan Transaksi selama masa berlakunya periode Tier sesuai dengan ketentuan yang terdapat Pasal 8.2.3.
9.1.6.6 Tingkatan Tier tidak akan berpengaruh atau berubah dengan adanya Redeem Poin.
9.2. Tata Cara Perolehan Poin Travelmate:
9.2.1 Poin didapat dari transaksi Member yang melakukan pemesanan kamar melalui platform mhg.id, Food & Beverage di Hotel dan Banquet dari total bill/kwitansi (tidak termasuk biaya pajak & pelayanan).
9.2.2 Setiap struk/bill transaksi yang telah diposting petugas hotel akan memperoleh Poin disesuaikan dengan nilai yang terdapat pada tabel konversi Poin (berlaku kelipatan dan penggabungan bill).
9.2.3 Member mengumpulkan Poin dari bill/kwitansi transaksi, yang diposting pada hari yang sama dengan tanggal transaksi di Hotel. Proses posting bill/kwitansi dilakukan oleh petugas hotel setelah member Check-Out dengan masa validasi maksimal H+3 (dalam waktu tiga hari kerja).
9.2.4 Jika penerapan skala Poin yang diperoleh menghasilkan Poin dengan pecahan desimal, jumlah Poin yang dikreditkan akan menjadi angka bulat terendah berikutnya jika angka setelah titik desimal lebih rendah dari lima dan angka tertinggi berikutnya jika desimalnya sama dengan atau lebih tinggi dari lima.
9.2.5 Poin Travelmate berlaku selama 3 tahun atau 1095 hari berturut-turut sejak Transaksi dinyatakan memenuhi syarat dan ketentuan untuk memperoleh Poin dan Poin dikreditkan ke akun Member Travelmate.
9.2.6 Pada akhir masa berlaku Poin Travelmate di akun Member akan kadaluwarsa.
9.3. Tata cara penukaran Poin Travelmate, dijelaskan sebagai berikut:
9.3.1 Poin dapat digunakan sebagai potongan harga kamar untuk booking online via Platform mhg.id.
9.3.2 Poin yang telah digunakan sebagai potongan harga pada saat pemesanan kamar melalui platform mhg.id tidak dapat dikembalikan, meskipun terjadi pembatalan baik sebelum maupun sesudah pembayaran dilakukan.
9.3.3 Poin yang terkumpul dapat ditukarkan menjadi pilihan E-voucher Metland Travelmate senilai Rp50.000 dan Rp100.000, E-Voucher Merchant dan beberapa pilihan lainnya.
9.3.4 Poin yang ditukarkan dalam bentuk pilihan E-Voucher Merchant melalui Platform, masa penggunaan E-Voucher Merchant berlaku selama 30 (tiga puluh) hari dari tanggal penukaran poin atau ditentukan lain oleh penentu kebijakan. Dan setiap E-Voucher Merchant yang sudah ditukarkan namun belum digunakan oleh Member pada saat masa berlaku berakhir, maka jumlah poin akan tetap dikurangi sesuai dengan jumlah pengajuan penukaran E-Voucher Merchant.
9.4. Tata cara penggunaan E-Voucher Travelmate, dijelaskan sebagai berikut:
9.4.1 E-Voucher Travelmate dapat digunakan untuk pembayaran pemesanan kamar melalui platform mhg.id.
9.4.2 Masa berlaku E-voucher Travelmate selama 3 (tiga) bulan atau 90 (sembilan puluh) hari terhitung dari tanggal penukaran/redeem poin.
9.4.3 Transaksi pembayaran dengan E-voucher Travelmate tidak dapat dihitung sebagai Poin dan pencapaian Tier.
9.5. Tata cara penggunaan E-Voucher Metland yang dimiliki Member Metland Card pada Layanan Travelmate, dijelaskan sebagai berikut:
9.5.1 Member Metland Card harus melakukan koneksi akun Metland Travelmate dengan Metland Card dari halaman profile Member pada Platform mhg.id.
9.5.2 Member Metland Card dapat mengikuti tahapan proses koneksi akun pada Platform mhg.id.
9.5.3 E-voucher Metland dapat digunakan untuk pembayaran pemesanan kamar melalui platform mhg.id, dan pembayaran pemesanan Food and Beverage (F&B) di hotel.
9.5.4 Masa berlaku E-voucher Metland selama 1 (satu) bulan atau 30 (tiga puluh) hari terhitung dari tanggal penukaran/redeem poin melalui aplikasi Metland Card.
9.5.5 Transaksi pembayaran dengan E-voucher Metland tidak dapat dihitung sebagai penambahan Poin dan pencapaian Tier.
9.6 Benefit Program yang diberikan kepada Member Metland Travelmate sesuai dengan tingkatan Tier yang dicapai pada saat tanggal pemesanan kamar. Benefit Tier membership diinformasikan lebih lengkap pada menu Profile Akun Member di platform mhg.id, dengan ketentuan sebagai berikut:
9.6.1 Special Member Rates adalah harga publish platform mhg.id dengan potongan harga yang spesial diberikan kepada semua tingkatan Tier Member, yang dijelaskan sebagai berikut:
9.6.2 Member harus melakukan pemesanan kamar Hotel melalui Platform mhg.id.
9.6.3 Special Member Rates berupa diskon sebesar 2% hingga 10% dari harga kamar termasuk biaya pajak & pelayanan (tax and services charge), dan disesuaikan dengan ketersediaan kamar di hotel pada tanggal yang dipilih.
9.6.4 Special Member Rates juga dapat digunakan bersamaan dengan promosi atau penawaran khusus lainnya, sesuai syarat dan ketentuan yang berlaku.
9.6.5 Online Check In Offers merupakan Benefit untuk semua Tier Member yang menawarkan proses Check-in secara online melalui platform CRM Metland Travelmate dengan kententuan sebagai berikut;
9.6.5.1 Online Check In Benefit berbentuk penawaran yang dikirimkan melalui E-mail setelah Member melakukan Transaksi pemesanan kamar melalui Platform mhg.id.
9.6.5.2 Member dapat menikmati Benefit dan mengikuti proses Online Check-in serta Syarat dan Ketentuan yang dijelaskan melalui E-mail.
9.6.5.3 Benefit ini baru dapat dinikmati di Hotel Horison Ultima Seminyak dan Metland Venya Ubut
9.6.6 Complimentary Stay Program (Coming Soon 2026) merupakan benefit complimentary menginap setelah akumulasi menginap tertentu. Tata cara penukaran Complimentary Stay Program, dijelaskan sebagai berikut:
9.6.6.1 Member harus melakukan transaksi booking secara online melalui Platform mhg.id selama 10 malam dan atau 10 kamar di semua jaringan Metland Hotels Group dalam periode tertentu dan tidak berlaku untuk pemesanan booking kamar melalui platform lain.
9.6.6.2 Periode Program terhitung selama 365 hari sejak transaksi booking online pertama dilakukan.
9.6.6.3 Pada akhir periode, Program akan kadaluwarsa apabila Member tidak mencapai akumulasi menginap sesuai ketentuan pada Pasal 9.2.6 dan akumulasi perhitungan transaksi sebelumnya akan di kembalikan menjadi 0 malam atau 0 kamar.
9.6.6.4 Perhitungan menginap per malam dan atau kamar akan berlaku setelah Transaksi memenuhi Syarat dan Ketentuan pada saat Member Check Out dengan masa validasi maksimal H+3 (dalam waktu tiga hari kerja).
9.6.6.5 Setelah mencapai menginap 10 malam dan atau kamar (akumulatif), Member berhak atas 1 malam Complimentary Stay Voucher.
9.6.6.6 Nominal 1 Complimentary Stay E-Voucher senilai harga rata-rata dari akumulasi 10 malam dan atau 10 kamar dari pemesanan kamar di semua jaringan Metland Hotels Group melalui platform mhg.id.
9.6.6.7 Complimentary Stay E-Voucher dapat digunakan di seluruh jaringan Metland Hotels Group sesuai dengan ketersediaan kamar dan harga yang berlaku pada tanggal pemesanan kamar melalui Platform mhg.id.
9.6.7 Member di Tier Preferred dan Luxury akan mendapatkan Benefit Program; Late Check-out atau Early Check-in dan Room Upgrades, yang akan dijelaskan sebagai berikut:
9.6.7.1 Late Check-out atau Early Check-in dapat dipilih salah satu dan mengikuti ketersediaan kamar Hotel pada tanggal tersebut.
9.6.7.2 Room Upgrades mengikuti ketersediaan kamar Hotel pada tanggal tersebut.
9.6.7.3 Late Check-out paling lambat pukul 16.00 waktu setempat.
9.6.7.4 Early Check-In tercepat pada pukul 10.00 waktu setempat.
9.6.7.5 Member yang dapat memanfaatkan Benefit ini dengan Booking kamar melalui platform mhg.id dan menyertakan catatan pada kolom “Special Request”.
9.6.7.6 Pihak Hotel akan mengkonfirmasi ketersediaan kamar pada saat proses Reservasi Check-in di Hotel.
9.6.8 Diskon F&B merupakan program benefit yang ditawarkan kepada Member sesuai Tier, dengan ketentuan sebagai berikut:
9.6.8.1 Tier Premium mendapat diskon F&B sebesar 10%, Tier Preferred mendapat diskon F&B sebesar 15% dan Tier Luxury mendapat diskon F&B sebesar 20%;
9.6.8.2 Penghitungan diskon adalah nilai dari total Transaksi termasuk biaya pajak & pelayanan (tax and services charge);
9.6.8.3 Diskon F&B hanya berlaku di outlet restaurant Hotel dan tidak berlaku untuk Banquet;
9.6.8.4 Member akan diberikan semua informasi di Hotel.
9.7 Benefit Spesifik Hotel (eXcare) yang diberikan kepada Member Metland Travelmate sesuai dengan tingkatan Tier yang dicapai pada saat tanggal pemesanan kamar. Benefit Tier membership diinformasikan lebih lengkap pada menu Profile Akun Member di platform mhg.id, dengan ketentuan sebagai berikut:
9.7.1 Benefit Car Window Cleaning pada Tier Premium, Preferred, Luxury:
9.7.1.1 Benefit berupa pembersihan kaca mobil Member saat kedatangan di setiap masa menginap;
9.7.1.2 Benefit ini hanya berlaku untuk Member yang melakukan reservasi dan menginap di Hotel;
9.7.1.3 Jika masa inap Member lebih dari satu malam akan dianggap sebagai satu kali masa inap;
9.7.1.4 Member wajib menginformasikan plat nomor mobil yang ingin mendapatkan Benefit ini;
9.7.1.5 Jumlah mobil yang mendapatkan Benefit ini mengikuti kebijakan Manajemen Hotel.
9.7.2 Benefit Welcome Drink pada Tier Premium, Preferred, Luxury. Welcome Fruit or Snack pada Tier Preferred dan Luxury:
9.7.2.1 Benefit ini hanya berlaku untuk Member yang melakukan reservasi dan menginap di Hotel;
9.7.2.2 Benefit berupa voucher fisik yang diberikan kepada Member saat kedatangan di setiap masa menginap;
9.7.2.3 Voucher dapat ditukarkan langsung dibagian Reservasi Hotel;
9.7.2.4 Jika Member Check-in dan Check-out pada hari yang sama di Hotel yang sama akan dianggap sebagai satu kali masa inap;
9.7.2.5 Jika masa inap Member lebih dari satu malam akan dianggap sebagai satu kali masa inap dan tidak akan mendapatkan voucher tambahan;
9.7.2.6 Jumlah voucher dan pilihan menu minuman dan atau buah dan atau snack ditentukan oleh pihak Hotel;
9.7.2.7 Member akan diberikan semua informasi di Hotel;
9.7.2.8 Konsumsi minuman beralkohol tunduk pada peraturan setempat.
9.7.3 Benefit Shoe Polish pada Tier Luxury:
9.7.3.1 Benefit berupa pembersihan sepasang sepatu Member saat kedatangan di setiap masa menginap;
9.7.3.2 Benefit ini hanya berlaku untuk Member yang melakukan reservasi dan menginap di Hotel;
9.7.3.3 Benefit berupa voucher fisik yang diberikan kepada Member saat kedatangan di setiap masa menginap;
9.7.3.4 Jika Member Check-in dan Check-out pada hari yang sama di Hotel yang sama akan dianggap sebagai satu kali masa inap;
9.7.3.5 Jika masa inap Member lebih dari satu malam akan dianggap sebagai satu kali masa inap dan tidak akan mendapatkan voucher tambahan;
9.7.3.6 Metode pembersihan sepatu mengikuti kebijakan Manajemen Hotel.
9.7.4 Benefit Priority Welcome pada tier Luxury:
9.7.4.1 Benefit berupa akses prioritas pada saat Check-in di meja reservasi yang diberikan kepada Member di tingkatan Tier Luxury;
9.7.4.2 Benefit ini hanya berlaku untuk Member yang melakukan reservasi dan menginap di Hotel;
9.7.4.3 pada saat Check-in;
9.7.4.4 Ketentuan lainnya mengenai Benefit Priority Welcome mengikuti kebijakan Manajemen Hotel.
9.8 Lain-lain
9.8.1 Setiap Poin, E-Voucher, Complimentary Stay Voucher dan Benefit yang Anda dapatkan tidak dapat diklaim atau ditukarkan menjadi uang, baik melalui Kami atau pihak manapun, atau dialihkan atau dipindahtangankan kepada pihak manapun, baik dengan cara ditransfer atau dicairkan/diuangkan, atau dengan cara-cara apapun.
9.8.2 Kami berhak melakukan validasi atas semua Transaksi yang dianggap meragukan dan menolak semua Transaksi yang diragukan keabsahannya.
9.8.3 Kami berhak mengambil langkah hukum yang relevan terhadap Member sesuai dengan ketentuan hukum dan/atau peraturan perundang-undangan yang berlaku apabila Kami menemukan kecurangan pada posting Poin, penggunaan E-Voucher termasuk apabila Member mendapatkan Poin dengan cara tidak wajar, termasuk mengunduh struk belanja/kuitansi pembelian palsu, struk yang digandakan, dan lain-lain, dan Member wajib untuk mengganti/ mengembalikan sesuai dengan total nominal kerugian tersebut.
9.8.4 Transaksi yang dapat dihitung kedalam pencapaian Tier dan penukaran Poin adalah Transaksi yang memenuhi ketentuan sebagai berikut:
9.8.4.1 Transaksi Member yang melakukan pemesanan kamar melalui platform mhg.id, Food & Beverage di Hotel dan Banquet dari total bill/kwitansi.
9.8.4.2 Transaksi Booking yang dibatalkan tidak akan terhitung menjadi Poin terkecuali Transaksi non-refundable dan no-show.
9.8.4.3 Transaksi akan dihitung setelah Member Check-Out dari Hotel.
9.8.4.4 Transaksi pembayaran diluar penggunaan E-Voucher/Diskon Langsung/Complimentary Stay E-Voucher.
9.8.5 Kami berhak menolak dan tidak memproses Transaksi yang tidak memenuhi ketentuan Pasal 9.3.4 diatas.
9.8.6 Kami berhak mengoreksi jumlah poin yang telah dimasukan tanpa pemberitahuan sebelumnya apabila:
9.8.6.1 Transaksi tidak sesuai dengan syarat dan ketentuan pada Pasal 8.9.4 di atas.
9.8.6.2 Kesalahan verifikasi data oleh Kami.
9.8.7 Apabila terdapat keluhan terkait perhitungan Poin maka Member dapat menghubungi Kami.
9.8.8 Kami tidak bertanggung jawab atas penyalahgunaan Akun Member Metland Travelmate oleh pihak lain.
9.8.9 Kami berhak membuat verifikasi dan klarifikasi semua transaksi yang menggunakan E-voucher yang dianggap meragukan keabsahannya, dengan berhak meminta kepada Member untuk menunjukan bukti Transaksi pembayaran apabila diperlukan.
9.8.10 Dengan mengikuti program ini, Member dianggap telah menyetujui setiap ketentuan yang berlaku dalam Program Metland Travelmate.
10 Perubahan Syarat dan Ketentuan ini; Modifikasi Program
10.1 Perubahan Syarat dan Ketentuan Ini. Kami berhak untuk mengubah Syarat dab Ketentuan ini dari waktu ke waktu, dengan pemberitahuan yang wajar kepada Member sebagaimana dijelaskan dalam bagian ini. Kami akan memberi tahu Anda tentang perubahan Syarat dan Ketentuan dengan mempostingnya di situs Program dan juga dapat memberi tahu Anda melalui email atau surat ke alamat yang terhubung dengan akun Anda. Syarat dan Ketentuan yang diperbarui akan berlaku efektif sejak saat diposting, atau pada tanggal selanjutnya atau dengan metode lain yang ditentukan oleh Kami. Kecuali dinyatakan lain, Syarat dan Ketentuan yang diperbarui akan berlaku untuk partisipasi Anda dalam Program mulai tanggal efektifnya. Syarat dan Ketentuan ini hanya dapat diubah sesuai dengan bagian ini. Jika tidak, tidak ada karyawan, agen, atau perwakilan Kami atau Pihak Kami mana pun yang berhak atau berwenang untuk mengubah Syarat dan Ketentuan ini.
10.2 Modifikasi Program. Kami berhak, dari waktu ke waktu, antara lain: mengubah kemampuan perolehan; menarik, membatasi, mengubah, atau membatalkan rewards/penghargaan atau manfaat apa pun; membatalkan atau mengubah rewards/penghargaan atau program mitra; menambah atau mengubah poin atau persyaratan lain untuk mendapatkan rewards/penghargaan atau manfaat; mengubah atau mengatur pengalihan poin, penghargaan, atau manfaat; mengubah tingkatan keanggotaan atau manfaat yang tersedia untuk setiap tingkatan; menambahkan tanggal blackout; atau membatasi jumlah kamar yang tersedia untuk penukaran penghargaan di salah satu atau semua destinasi. Kami dapat membatasi jumlah peserta Program dan dapat menghentikan pendaftaran Member baru untuk sementara atau permanen kapan saja dan untuk alasan apa pun tanpa pemberitahuan.
10.3 Kami tidak bertanggung jawab atas penarikan mitra dari Program, perubahan layanan mitra, atau masalah terkait perolehan atau penggunaan poin atau penghargaan yang disebabkan oleh penarikan mitra mana pun.
10.4 Program ini mungkin berisi outbond links ke situs web lainnya yang dioperasikan oleh Kami. Saat menggunakan situs-situs web tersebut, Member perlu menyetujui syarat dan ketentuan terpisah yang mungkin berbeda dengan Syarat dan Ketentuan ini.
11 Larangan
11.1 Dengan mengakses dan menggunakannya Program ini, Member dianggap telah menyetujui Syarat dan Ketentuan.
11.2 Dalam menggunakan Program, Member tidak boleh terlibat dalam salah satu tindakan berikut ini:
11.2.1 Tindakan pelanggaran atas properti atau privasi, dan lain-lain, dari Kami dan/atau pihak ketiga, atau melakukan tindakan apapun yang dapat menyebabkan pelanggaran tersebut.
11.2.2 Setiap tindakan yang menyebabkan kerugian atau kerusakan kepada Kami dan/atau pihak ketiga.
11.2.3 Setiap tindakan melanggar hukum seperti pengumpulan, pengungkapan, pemalsuan atau penghapusan informasi Kami dan/atau pihak ketiga (antara lain, informasi yang terdaftar, informasi riwayat penggunaan dan informasi lainnya), atau tindakan apapun yang dapat menyebabkan hal tersebut.
11.2.4 Setiap tindakan yang mengakses Program (termasuk server dan jaringan yang terhubung dengan Program) tanpa izin atau dengan cara lain secara melanggar hukum, atau tindakan lainnya yang menghambat penggunaan atau operasinya, atau tindakan yang dapat menyebabkan hal tersebut termasuk tindakan-tindakan sehubungan dengannya yang menyebabkan kerugian bagi Kami dan/atau pihak ketiga.
11.2.5 Setiap tindakan yang melanggar ketertiban umum, kesusilaan atau moral, atau tindakan yang dapat menyebabkan hal tersebut.
11.2.6 Setiap tindakan melanggar hukum atau tindakan yang berhubungan dengan tindakan melanggar hukum, atau tindakan yang dapat menyebabkan hal tersebut.
11.2.7 Setiap tindakan pernyataan atau deklarasi palsu atau penyerahan termasuk memberikan informasi yang tidak benar atau menyesatkan.
11.2.8 Setiap setiap tindakan menggunakan Program untuk mendapatkan keuntungan yang tidak sesuai dengan tujuan dari Program ini, atau setiap tindakan dalam mempersiapkan hal tersebut.
11.2.9 Setiap tindakan yang mencemarkan atau merusak nama baik Kami dan/atau pihak ketiga manapun.
11.2.10 Setiap tindakan yang menggunakan atau memberikan program yang merusak seperti virus komputer atau program perusak piranti lunak lainnya (termasuk namun tidak terbatas pada malware, trojan horse, dan lain-lain) atau setiap tindakan yang dapat menyebabkan hal tersebut.
11.2.11 Setiap tindakan yang menggunakan Program dengan berpura-pura menjadi pihak ketiga.
11.2.12 Setiap tindakan yang melanggar Syarat dan Ketentuan, dan Kebijakan Privasi, atau setiap tindakan yang dapat menyebabkan hal tersebut.
11.2.13 Setiap tindakan yang melanggar hukum dan peraturan baik di dalam maupun di luar negeri, setiap tindakan yang dapat menyebabkan hal tersebut, atau setiap tindakan yang melanggar tindakan administratif yang mengikat secara hukum.
11.2.14 Setiap tindakan lain yang dianggap tidak pantas oleh Kami dan/atau mengakibatkan adanya tanggung jawab pada Kami, baik secara langsung maupun tidak langsung.
11.2.15 Kami berhak mengambil langkah hukum yang relevan terhadap Member dalam setiap pelanggaran atas larangan-larangan di atas sesuai dengan ketentuan hukum dan/atau peraturan perundang-undangan yang berlaku.
12 Batasan Tanggung Jawab
12.1 Kami menyediakan Program ini sebagaimana adanya dengan selalu mengusahakan kualitas dan sistem pengamanan yang sebaik-baiknya. Namun Kami tidak menjamin bahwa Program sepenuhnya bebas dari error, bug, gangguan, kerusakan atau cacat lainnya.
12.2 Kami tidak membuat jaminan apapun mengenai keakuratan, ketepatan waktu, kegunaan, atau karakteristik lainnya yang terkait dengan informasi yang diterbitkan dalam Program. Kami dapat, dengan kebijakan Kami sendiri, menambah, mengubah, mengoreksi, atau menghapus informasi yang diterbitkan dalam Program setiap saat tanpa memberikan pemberitahuan sebelumnya kepada Member sepanjang diperkenankan oleh hukum dan/atau peraturan perundang-undangan yang berlaku. Dalam hal penambahan, perubahan, koreksi atau penghapusan informasi Program menyebabkan kerugian bagi Member, maka ketentuan Pasal 14 akan berlaku.
12.3 Kami dapat, dengan kebijakan Kami sendiri, menangguhkan atau menghentikan Layanan atau penampilan Program secara keseluruhan atau sebagian, untuk sebab-sebab yang termasuk, namun tidak terbatas pada, sebagai berikut:
12.3.1 Dalam hal adanya pemeliharaan atau perawatan secara berkala atau keadaan darurat atau peningkatan peralatan dan sistem untuk publikasi Program.
12.3.2 Dalam hal layanan atau penampilan Program sulit untuk dilaksanakan karena hal-hal yang berada di luar kendali Kami seperti kebakaran, mati listrik, bencana alam, keadaan perang atau darurat sipil/militer, gangguan telekomunikasi (termasuk pemutusan jaringan internet) dan lain sebagainya yang berada di luar kendali Kami.
12.3.3 Dalam hal layanan telekomunikasi tidak disediakan oleh operator telekomunikasi.
12.3.4 Saat Kami telah menetapkan penangguhan sementara atau pemberhentian Program dibutuhkan untuk operasional atau alasan-alasan teknis, atau Kami telah menetapkan atas keadaan yang tidak terduga, maka layanan atau penampilan Program terlalu sulit untuk dilakukan.
12.3.5 Dalam hal adanya perintah dari aparat yang berwenang dan/ atau suatu putusan pengadilan berdasarkan hukum dan/atau peraturan perundang-undangan yang berlaku.
12.3.6 Dalam hal Kami memiliki alasan untuk percaya bahwa suatu serangan siber atau gangguan keamanan atas sistem yang kredibel telah, sedang, atau akan terjadi dalam waktu dekat.
12.4 Dalam hal setiap kerugian atau kerusakan terjadi pada Member atau pihak ketiga karena penangguhan sementara atau penghentian Layanan atau penampilan Program, ketentuan Pasal 14 akan berlaku.
12.5 Member dapat mengakhiri penggunaannya dengan menghapus Akun Membership yang telah didaftarkan dan diakses dalam perangkat yang digunakan.
12.6 Bahkan jika Member mengakhiri penggunaan Program, informasi Member yang diperoleh oleh Kami melalui Program tidak akan dihapus. Penanganan informasi tersebut dari Member akan disesuaikan dan diperlakukan sesuai dengan ketentuan dalam Kebijakan Privasi serta hukum dan/atau peraturan perundang-undangan yang berlaku untuk data pribadi.
12.7 Dalam hal Member melanggar ketentuan dalam Syarat dan Ketentuan, Kami memiliki hak untuk menghilangkan atau memberhentikan sementara hak Member berdasarkan Syarat dan Ketentuan dan hak Member untuk menggunakan Program tanpa pemberitahuan sebelumnya kepada Member. Kami tidak akan bertanggung jawab atas kerugian atau kerusakan yang terjadi pada Member sebagai akibat dari Kami dalam melaksanakan hak-hak yang tertera dalam pasal ini. Untuk tujuan pengakhiran hak Member di atas, para pihak setuju untuk mengabaikan Pasal 1266 Kitab Undang-Undang Hukum perdata.
12.8 Dalam hal sebuah tautan dari Program mengacu ke situs web atau aplikasi pihak ketiga, Kami tidak akan bertanggung jawab atas setiap situs web atau aplikasi pihak ketiga selain Program ini. Dalam keadaan tersebut, Kami tidak akan bertanggung jawab atas isi, iklan, produk, layanan, dan lain-lain, termasuk konten maupun isi dalam situs web atau aplikasi pihak ketiga tersebut dan yang tersedia untuk penggunaan situs web atau aplikasi pihak ketiga tersebut termasuk tindakan-tindakan Member pada situs web atau aplikasi pihak ketiga tersebut. Kami, tidak akan bertanggung jawab untuk memberikan kompensasi atas kerusakan yang diakibatkan oleh atau terjadi karena berhubungan dengan setiap isi, iklan, produk, layanan, dan lain sebagainya, yang bukan merupakan produk dari Kami dan/atau Manajemen. Dengan menyediakan tautan atau menyediakan akses ke situs web atau aplikasi pihak ketiga, Kami tidak memberikan setiap pernyataan, jaminan atau pengesahan, secara tegas atau tersirat, berkenaan dengan legalitas, akurasi, kualitas atau keaslian konten, informasi atau jasa yang disediakan oleh situs web atau aplikasi pihak ketiga tersebut.
13 Merek Dagang / Hak Kekayaan Intelektual
Member tidak boleh menyalin, membuat ulang, mendistribusikan, mengirimkan, menyiarkan, menampilkan, menjual, melisensikan atau mengeksploitasi setiap Merek dagang yang terdapat dalam Program untuk tujuan apapun.
14 Ganti Rugi
14.1 Kami tidak akan bertanggung jawab atas setiap kerusakan atau kerugian apapun yang terjadi pada Member atau pihak ketiga yang berhubungan dengan perubahan, gangguan, penangguhan, pemberhentian atau pengakhiran dan lain sebagainya pada Program sejauh mana diperkenankan oleh hukum dan/atau peraturan perundang-undangan yang berlaku.
14.2 Kami tidak akan bertanggung jawab atas kerusakan yang disebabkan oleh peristiwa atau kejadian tertentu yang berada di luar dugaan Kami maupun yang bersifat force majeure atau dikarenakan keadaan terpaksa sepanjang diperkenankan oleh hukum dan/atau peraturan perundang-undangan yang berlaku.
14.3 Dalam hal Member menyebabkan kerusakan dan/atau kerugian kepada pihak ketiga sehubungan dengan penggunaan Program, Member harus bertanggung jawab untuk menyelesaikan kerusakan dan/atau kerugian tersebut dengan biaya Member dan tidak akan meminta Kami untuk bertanggung jawab atas tindakan yang dilakukan oleh Member sendiri. Dalam hal Member menyebabkan kerusakan dan/atau kerugian pada Kami melalui tindakan yang melanggar Syarat dan Ketentuan serta hukum dan/atau peraturan perundang-undangan yang berlaku, Kami dapat meminta ganti rugi atau kompensasi yang sepadan atas kerusakan dan/atau kerugian yang disebabkan oleh Member termasuk mengambil langkah-langkah hukum terhadap Member sebagai akibat dari tindakan yang dilakukakannya.
14.4 Sejauh diperkenankan oleh hukum dan/atau peraturan perundang-undangan yang berlaku, Member setuju untuk membela, mengganti rugi dan membebaskan Kami pemegang saham, sponsor, mitra usaha Kami, direktur, komisaris, karyawan dan agen, dari dan terhadap setiap dan semua klaim, kerusakan, kewajiban, kerugian, tanggung jawab, biaya atau hutang dan pengeluaran (termasuk, namun tidak terbatas pada, biaya penasihat hukum) yang timbul dari:
(i) Penggunaan atau akses Member terhadap layanan Kami yang disebabkan oleh kelalaian Member
(ii) Pelanggaran terhadap Syarat dan Ketentuan ini; dan/atau
(iii) Pelanggaran oleh Member terhadap pihak ketiga
15 Data Pribadi
15.1 Member setuju bahwa Kami dapat memperoleh, menyimpan, mengelola, menggunakan dan mentransfer data pribadi Anda untuk tujuan menyediakan Layanan dalam Program ini.
15.2 Pengelolaan data pribadi harus dilakukan secara patut sesuai dengan Kebijakan Privasi yang ditentukan secara terpisah oleh Kami.
16 Keterpisahan
Apabila salah satu atau lebih ketentuan dalam Syarat dan Ketentuan ini dinyatakan tidak sah, batal atau tidak dapat diberlakukan, ketentuan tersebut harus dianggap terpisah dan tidak akan mempengaruhi validitas dan/atau keberlakukan ketentuan-ketentuan lainnya dalam Syarat dan Ketentuan yang tetap memiliki kekuatan hukum penuh dan berlaku.
17 Keseluruh Perjanjian
Syarat dan Ketentuan ini merupakan perjanjian yang lengkap dan eksklusif antara Anda dan Kami sehubungan dengan Program. Syarat dan Ketentuan ini menggantikan semua komunikasi, perjanjian, iklan, dan proposal sebelumnya atau saat ini, baik secara elektronik, lisan, atau tertulis, sehubungan dengan Program ini atau versi lain dari program loyalitas pelanggan dari Kami atau Pihak Kami. Baik Anda maupun Kami mengakui bahwa tidak satu pun dari Anda yang dibujuk untuk menyetujui Syarat dan Ketentuan ini oleh pernyataan atau janji apa pun yang tidak secara khusus dinyatakan dalam Syarat dan Ketentuan ini.
18 Hukum yang Berlaku
Syarat dan Ketentuan ini diatur oleh Hukum Indonesia.
19 Penyelesaian Perselisihan
Setiap perselisihan yang timbul dari atau berkenaan dengan Syarat dan Ketentuan ini, termasuk namun tidak terbatas pada setiap pertanyaan tentang keberadaan, validitas atau pengakhirannya, yang tidak dapat diselesaikan secara damai, harus diselesaikan melalui Pengadilan.
20 Bahasa
Jika terdapat perbedaan atau ketidakkonsistenan antara versi bahasa Inggris dan versi bahasa Indonesia dari Syarat dan Ketentuan ini, versi bahasa Indonesia akan berlaku, mengatur, dan mengendalikan.
21 Pemberitahuan
Anda setuju untuk menerima semua komunikasi termasuk pemberitahuan, perjanjian, pengungkapan, informasi lain dari Kami atau dengan mengunggahnya pada fitur dalam Layanan. Untuk pertanyaan terkait, Anda dapat menghubungi dan/atau menyampaikan pemberitahuan melalui alamat email: info@mhg.id.

Welcome to the official Platform of Metland Hotels Group ("Metland Hotel") which is an affiliate of PT Metropolitan Land, Tbk. This page contains General User Terms for every individual who uses Metland Hotel's product and/or service services ("Terms of Service"). By accessing this page and using the Services, it means that you and Metland Hotel are bound by an agreement. Therefore, you are deemed to have understood and stated your agreement to the commitment to the applicable provisions. Metland Hotel urges you to read these Terms of Use carefully.
In these provisions, we also determine the basis for obtaining, collecting, processing, analyzing, displaying, opening, and/or any form of management related to data or information that Users provide to Metland Hotel and/or Metland Hotel collected from Users, including User's personal data, both when Users register on the Site, access the Site, or use services on the Site (hereinafter referred to as "data"), as in the Metland Group Privacy Policy.

Metland Hotels Group chooses PT Nusa Satu Inti Artha (DOKU) as a payment processing technology licensed by Bank Indonesia with license number 14/898/DASP, dated December 20, 2012, to enable online payment verification. Validity of customer payment cards & other payment methods listed in Metland Hotels Group operated by DOKU Payment Services and the bank selected as a facilitator for credit cards.
Card payments can be declined for several reasons: stolen or blocked cards, credit limit reached, entry errors, etc. In case of problems, customers need to contact the bank and hotel to confirm the reservation and payment method.

retargeting, promotions, personalized offers, subscriptions, event

provide the services/experiences that are most important to you.
d. Analyzing Customer behavior to provide a better experience/service,
We use your Personal Data and your interactions with Our services/products
fully to analyze your behavioral patterns in using Our services/products.
Service/product development is based on Our understanding of what
Customers need most.
e. To provide relevant advertisements to you, We will use your
non-personally-identifiable attributes and cookies to display relevant
advertisements to you.
f. To inform you about the benefits, programs, and opportunities that
We provide to you, We and/or Affiliates can communicate to you about the
benefits, programs, and opportunities that can be provided by Metland
Hotel products/services.

with third parties related to Metland Hotel products/services that are in
contact with Customers. We ensure that these third parties are selected
with care and are obliged to keep Your data safe. We also share Your
information with third parties who we think can provide content, products,

potential illegal activities and enforce Our Terms and Conditions. We also
use various technology systems to detect unusual activities for abuse,

i. In order to get your suggestions and input from time to time, we may ask Customers to provide suggestions, so that the product/service is more in line with what Customers need and are interested in.

a. Logging

We automatically record the Internet Protocol (IP) address of visitors (web based application) and user sessions (mobile application). We also record some materials to identify unique visitors to Our Site, including:

Some of our
products/services are connected to other sites created and maintained by other
parties. When you enter another site/application, it means you leave our
domain, then this Privacy Policy does not apply.
c. Do Not Track
(DNT)
Do Not Track is a
self-regulatory initiative designed by the online advertising industry to
provide consumers with choices in the types of advertisements they may see and
choose from online behavioral ads provided by companies participating in this
program. We do not respond to DNT on consumer browser settings.
d. Response to
legal requests
We reserve the right to
share your information in response to requests for information from authorized
Government authorities or required by law.
e. Cookies
i. Cookies are small files that will automatically take place on the User's device that perform the function of storing the User's preferences or configurations while visiting a site.
ii. These cookies are not intended to be used when accessing other data that the User has on the User's computer device, other than what the User has agreed to submit.
iii. Although the User's computer device will automatically receive cookies, the User can choose to make modifications through the User's browser settings, namely by choosing to reject cookies (this option can limit optimal service when accessing the Site).
iv. Metland Hotel uses the Google Analytics Demographics and Interest feature. The data we obtain from this feature, such as age, gender, User interests and others, will be used for the development of the Metland Hotel Site and content. If you do not want your data to be tracked by Google Analytics, you can use the Google Analytics Opt-Out Browser Add-On.
v. Metland Hotel can use features provided by third parties in order to improve Metland Hotel services and content, including among others, the adjustment and presentation of advertisements to each User based on interests or visit history. If you do not want advertisements to be displayed based on these adjustments, you can set it through the browser.
7. Control of
Your Information
If you are a registered user, you can review, revise, and correct your Personal Data through the Customer profile setting service on the Metland Hotel Platform.
8. Security
The confidentiality of your data and Personal Data is our primary concern. We make the best efforts and procedures to protect and guarantee Personal Data. However, we cannot guarantee 100% that Our system is impenetrable by viruses, malware, and interference from third parties. Please do not disclose and share your Personal Data, including your account password and keep your device secure.
9. Updates
and/or Changes
Metland Hotel may at any time make changes or updates to these Terms of Service. Metland Hotel recommends that Users read carefully and check the Metland Group privacy policy page and these Terms & Conditions from time to time for any changes. By continuing to access and use the Site services or other Metland Hotel services, Users are deemed to agree to the changes in these Terms & Conditions.
10. Other
Provisions
a. Applicable Law and Jurisdiction
These Terms & Conditions are made and interpreted by the laws of the Republic of Indonesia. Any disputes arising from these Terms & Conditions refer to the jurisdiction of the Bekasi District Court.
b. Language These Terms & Conditions are made in Indonesian and English. In the event of any discrepancy between the Indonesian and English versions, the Indonesian version shall be deemed to apply.
11. Statement

IV. Disclosure of Personal Data
1. Business Units within Metland Group
The personal data you provide to us will be processed for the purposes
outlined in Section 3 (Purposes of Collecting & Processing Personal Data,
including Disclosure of Your Personal Data). We will ensure that access to your
personal data is restricted only to staff and/or those who are contractually
obligated to process the data in accordance with their duties within Metland
Group. To avoid any misinterpretation, if a contract with an employee or staff
member of Metland Group ends, access to all personal data stored and managed by
Metland Group will be terminated from the date the contract ends.
2. Third party
Your personal data may be disclosed to third parties as required by law in Indonesia, according to the relevant contract or business relationship, or for the purposes outlined in Section 3 (Purposes of Collecting & Processing Personal Data, including but not limited to the Disclosure of Your Personal Data). The third parties in question may include:
a. Professional advisors and corporate service providers, such as auditors, lawyers, company secretaries, and public consultants;
b. Advertising and marketing partners;
c. Payment processors;
d. Customer support and communication services;

Fulfillment of Contractual Obligations refers to meeting the obligations under a contract when you are involved in an agreement and/or to fulfill your request when entering into an Agreement.

Compliance with legal obligations that can serve as the basis for processing your personal data refers to our fulfillment of legal duties under the laws and regulations applicable in Indonesia

Vital Interests refers to processing your personal data for the purpose of safeguarding your life or physical integrity.
5. Legitimate Interests
Legitimate Interests refers to processing your personal data for the fulfillment of other legitimate interests, considering the purpose, necessity, and balance of our interests and your rights
The collection of your personal data,
conducted with prior consent, grants us the right to transfer your data outside
of Indonesia. We will take reasonable and appropriate measures to protect the
transferred personal data, including encryption. Additionally, we will provide
contractual protections for the transfer of personal data to Metland Group
outside of Indonesia.
1. Data Security
In the event of a breach of personal data protection, we will provide written notification within a maximum of 3 x 24 (three times twenty-four) hours to:
a. The Data Subject; and
b. The Personal Data Protection Authority.
2. Data Storage
We will store your personal data for 5 years and/or for the period required or permitted by the applicable laws in Indonesia to fulfill the following purposes:
a. The purpose for which the data was collected,
b. Identified and ongoing business needs, including record-keeping,
c. Legal or regulatory requirements in Indonesia, and/or
d. IData storage needs related to ongoing investigations or legal proceedings
We will cease storing personal data or remove its association with you as an individual by deleting, discarding, anonymizing, and/or, if permitted by applicable law in Indonesia, blocking personal data under our control when:
a. The personal data is no longer required for the purpose for which it was collected;
b. The retention period has expired;
c. The storage is no longer necessary for business purposes or legal compliance;
d. The purpose for collecting personal data has been fulfilled; and
e. At your request to delete your account.
